BOA MINUTES 11/16/89 <br /> Page 4 <br /> CONDITION: <br /> 1) . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1) . Project is for beautification and stabilization after construction of new <br /> single family residence. <br /> 2) . Applicant has professional engineering data. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 3-0. <br /> #1914. Ellis - Dunn - 10/26/89 public hearing. <br /> Quackenbush/Harvey to grant variance of 28 feet more or less from required <br /> setback to normal high watermark to permit addition to existing building and <br /> allow above ground fuel tank and containment structure as proposed. Also, to <br /> grant special exception permit with conditions for fill, grade and retaining <br /> walls as proposed. <br /> CONDITIONS: <br /> 1) . Permits granted as per plans submitted and Sarko Plan #8-3-428. <br /> 2) . Incorporated into approval are the 3 conditions of the Dunn Plan <br /> Commissions letter dated November 14, 1989. <br /> 3) . Special Exception Permit valid for 10 months from granting. <br /> FINDING OF FACT: <br /> 1) . Applicant wishes to improve property with established campground. <br /> 2) . Applicant has diligently pursued necessary state and local permits. <br /> 3) . Special Exception work is proposed to have minimal earth disturbance. <br /> 4) . Setback variance is for addition to existing building, addition to be <br /> further from normal high watermark. <br /> CONCLUSION: <br /> (Variance) - 1. Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. 2. Variance is not contrary to rights of <br /> others or to the public interest. <br /> (Special Exception) - 1. The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and healthful <br /> conditions. Motion carried - 3-0. <br /> #1917. Town of Dunn/Dunn - 10/26/89 public hearing. <br /> Quackenbush/Harvey to grant, with conditions, permit to fill, grade and <br /> construct drainageway was proposed. <br /> CONDITIONS: <br /> 1) . Permit granted as per testimony given and plans submitted. <br /> 2) . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 3) . permit shall expire 6/1/90. <br /> FINDING OF FACT: <br /> 1) . Engineering data submitted by Town & Country Engineering. <br /> 2) . Project replaces and improves existing underground drainageway <br />
