Motion <br /> carried - 4-0. <br /> #1914. Ellis - Dunn. <br /> Jones/Harvey to hold in abeyance, not to exceed December Hearing, pending <br /> further investigation by applicant of the structural integrity of existing <br /> building, health, safety and drainage concerns. Motion carried - 4-0. <br /> #1915. Kornetzke - Dunn. <br /> Quackenbush/Kruschke to grant variance of 12 feet from required setback to <br /> normal high watermark to permit deck addition to residence. <br /> FINDING OF FACT: <br /> 1) . Deck is newly constructed without a zoning permit. <br /> 2) . 12 feet is sufficient for entry/exit from residence. <br /> 3) . 4 more or less feet will have to be removed to achieve compliance. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 4-0. <br /> #1916. Lewis - Dunn. <br /> Quackenbush/Harvey to grant, with condition, variance of 4.8 from required <br /> right sideyard to permit reconstruction of sidewall and roof of existing <br /> residence. <br /> CONDITION: <br /> 1) . Entire residence shall have rain gutters installed as to prevent waters <br /> from adversely impacting upon neighbors. <br /> FINDING OF FACT: <br /> 1) . This variance is an expansion of earlier Variance (1844) when project <br /> became more involved than anticipated. <br /> 2) . Applicant provided proof project identically duplicates original <br /> structure. <br /> 3) . No objections were received. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 4-0. <br /> #1917.
