BOA MINUTES 10/26/89 <br /> 4 Page 5 <br /> 0 <br /> Petitions from previous hearings: <br /> #1823. Potthast - Westport / 9/28/89 public hearing. <br /> Quackenbush/Harvey to deny requested permit for fill and grade. <br /> FINDING OF FACT: <br /> 1) . Applicant proposes to fill for speculative purposes while presently has <br /> developable lands available. <br /> 2) . Overwhelming testimony in opposition to proposed filling. <br /> 3) . Area is designated wetlands. <br /> 4) . Town Board recommends denial. <br /> CONCLUSION: <br /> 1) . The project as planned is in an environmental corridor and not consistant <br /> with plans adopted by several governmental agencies designation as open space. <br /> Motion carried - 4-0. <br /> #1899. Scheerenberger - Dunn / 9/28/89 public hearing. <br /> Rendall/Jones to grant, with conditions, permit to fill and grade after <br /> basement excavation. <br /> CONDITIONS: <br /> 1) . Permit is granted for distribution of existing materials only - no <br /> (0100 further excavated materials from this date. <br /> 2) . Provide appropriated erosion control measures to ensure stabilization <br /> through winter months also. <br /> 3) . Permit valid for 6 months from granting. <br /> 4) . That there be filed with the Zoning Department and certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1) . Materials for project come from basement excavation. <br /> 2) . Applicant wishes to level yard and utilize some sort of retaining <br /> structure. <br /> 3) . If further work is contemplated applicant may request reconsideration. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #1900. Pottinger - Dunn / 9/28/89 public hearing. <br /> Quackenbush/Rendall to grant, with conditions, permit to fill and grade for <br /> driveway and parking areas. <br /> CONDITIONS: <br /> 1) . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 2) . Permit valid for 30 days from approval. <br /> FINDING OF FACT: <br /> 1) . Excavated materials will be hauled off site. <br /> 2) . Project will stabilize areas of vehicular traffic and prevent erosion. <br /> 3) . Applicant will attempt to install a culvert to alleviate ponding. <br /> 4) . Don Mayo, P.E. , is representing applicant. <br />
