Pet. #8361 Page 2 CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.A filed deed restriction of the Town of Medina's Notification of Covenants and Restrictions restricting further development on the following described lands: Part of the NW 114 of the SW 114,the NE 114 of SW1/4,the SW 114 the SW 114,the SE 114 of the SW 114, and the SW 114 of the SE 114, all in Section 34, Town of Medina described as follows: Commencing at the West quarter corner of Section 34; thence N87°21'57" East, 2623.60 feet to the Northeast comer of the NE 114 of the SW 114; thence S00°32'11" West along the east line of said 114 114, 354.58 feet to the point of beginning; thence S87°21'57" West, 1380.38 feet to the centerline of a drainage ditch; thence S11°17'58" West along said centerline,2149.54 feet to the North line of Interstate Highway 94; thence N87°41'14"East along said North line, 1673.10 feet to the West line of Missouri Road and the point of curvature of a curve to the left, said curve having a central angle of 02°13'52" and a radius of 11354.19 feet,the long chord of which bears N04°28'06"East, 442.11 feet; thence Northeasterly along the arc of said curve, 442.14 feet thence NO3°21'10" East, 101.09 feet; thence N23°09'06" East, 212.57 feet; thence S86°38'50" East, 66.00 feet; thence S18°56'27' East, 216.16 feet; thence S03°21'10" West, 101.09 feet to the point of curvature of a curve to the right,said curve having a central angle of 00°58'03"and a radius of 11574.19 feet, the long chord of which bears S03°50'11" West, 195.43 feet; thence Southwesterly along the arc of said curve, 195.43 feet to its point of tangency thereof; thence S49°29'49' East, 233.93 feet; thence N87°41'14" East, 278.09 feet to the point of curvature of a curve to the left, said curve having a central angle of 00°36'57"and a radius of 68514.94 feet, the long chord of which bears N87°22'46" East, 736.31 feet; thence Northeasterly along the arc of said curve,736.32 feet to its point of tangency thereof and its intersection with the East line of the SW 114 of the SE 114 of said section; thence N00°43'11" East, 1103.84 feet to the Northeast corner of said 114 114; thence S86°32'15" West, 1329.15 feet to the Northwest comer of said 114 114; thence N00°32'11" East along the East line of the NE 114 of the SW 114, 954.50 feet to the point of beginning. This description includes the rezone areas plus an additional 70 acres as requested by the town. 2.Town of Medina's Notification of Covenants and Restrictions requiring rezoning for development to the remaining balance of 71 plus or minus acres.
