DYANN MAFNER WAUNAKEE.WI 53517 (SOS)541-5355 Mr. and Mrs. Edmund Porter 3624 Highway 151 Sun Prairie, Wisconsin 53590 Re: Legler Waterway Tax Assessment Dear Mr. and Mrs. Porter: As we discussed in my office on September 22, 1986, the Town Board of the Town of Burke made the decision to postpone constructing a retention pond as part of the Legler waterway project. This means that you will not be assessed $45,000.00 at this point in time. You should be aware of the fact, however, that the Board does intend to constuct a retention pond sometime in the future. This may be anywhere from two to five years down the road. When the Board makes the decision to construct the retention pond, they will once again be placed in the position of having to decide which property owners to assess for the project. They may assess only those individuals owning commercially zoned property, or they may also decide to assess those individuals owning agriculturally zoned property. In other words, you may or may not be placed in the same position you were in last month's several years from now. In the meantime, it would not be in your best interest to re-zone your property from commercial to agricultural. The property should remain commercially zoned so as to give you an opportunity to sell your property to a commercial developer if the situation arises. If the property were re-zoned to agricultural, I am told that the Dane County Zoning Committee would refuse to allow you to re-zone it to commercial sometime in the future. Pursuant to your request, I have requested that your Petition for re-zoning be withdrawn from any further consideration. Enclosed please find my letter dated September 24, 1986 to the Land Records Committee. This request will be formally brought up before the Board on October 28, 1986. According to Mr. Fleck, neither you nor I need appear at this meeting because my letter clearly states your position. Mr. Fleck also states that he doesn't anticipate any problems and agree to send me a letter confirming the Board's decision to allow you to withdraw your petition. Upon receipt, I will mail you a copy of the letter. In regard to your attorneys fees, our records now indicate that you have paid the fees in full through the August statement.
