This means <br /> that you will not be assessed $45,000.00 at this point in time. <br /> You should be aware of the fact, however, that the Board does intend <br /> to constuct a retention pond sometime in the future. This may be <br /> anywhere from two to five years down the road. When the Board makes <br /> the decision to construct the retention pond, they will once again <br /> be placed in the position of having to decide which property owners <br /> to assess for the project. They may assess only those individuals <br /> owning commercially zoned property, or they may also decide to assess <br /> those individuals owning agriculturally zoned property. In other <br /> words, you may or may not be placed in the same position you were in <br /> last month's several years from now. <br /> In the meantime, it would not be in your best interest to re-zone <br /> your property from commercial to agricultural. The property should <br /> remain commercially zoned so as to give you an opportunity to sell <br /> your property to a commercial developer if the situation arises. If <br /> the property were re-zoned to agricultural, I am told that the Dane <br /> County Zoning Committee would refuse to allow you to re-zone it to <br /> commercial sometime in the future. <br /> Pursuant to your request, I have requested that your Petition for <br /> re-zoning be withdrawn from any further consideration. Enclosed <br /> please find my letter dated September 24, 1986 to the Land Records <br /> Committee. This request will be formally brought up before the Board <br /> on October 28, 1986. According to Mr. Fleck, neither you nor I need <br /> appear at this meeting because my letter clearly states your position. <br /> Mr. Fleck also states that he doesn't anticipate any problems and agree <br /> to send me a letter confirming the Board's decision to allow you to <br /> withdraw your petition. Upon receipt, I will mail you a copy of the <br /> letter. <br /> In regard to your attorneys fees, our records now indicate that you <br /> have paid the fees in full through the August statement.
