Black Earth
William Fleck
September 29, 1986
Dane County Zoning Administrator
Room 116, City-County Building
Madison, Wisconsin 53709
Re: Zoning Petition #3737
Dear Mr. Fleck:
The Town Board of the Town of Vermont wishes to make clear
that its action in approving Zoning Petition #3737 does not
represent a change in Policy III 6 of the Town of Vermont Land
Use Plan. It is still the policy of the Town Board as expressed
in that document that each proposed lot must abut on a public
highway and that the access driveway must enter the lot from that
road frontage .
However, the Board determined, as permitted under Policy
III 6, that in this specific instance unique circumstances warranted
deviation from the policy in that the topography of the proposed
lot would make access to the abutting road directly over the lot
impossible and no driveway could be constructed on the proposed
lot which would comply with the standards of the town driveway
ordinance. The approval of Zoning Petition #3737 by the Town Board
of the Town of Vermont was based upon facts unique to that case
and does not indicate that any future petitions will be approved
in which access to the proposed lot is provided by an easement over
adjacent parcels. To the contrary, such easements violate the
general policy of the Town of Vermont Land Use Plan.
On behalf of the Town Board of the Town of Vermont I request
that this letter be attached to the Resolution of the Board approv-
ing Zoning Petition #3737 dated August 11, 1986 so that it will be
clear that the Board does not regard its approval as setting a
precedent for decisions on future rezoning petitions.
Sincerely,
CD(4/-1._ 67,102,4.4„6.ee
DANE COUNTY Don Parrell
r-AND RED. & RECORDS Chairman
SEP 3 p 3986
ZONING DIV
