CALL TO ORDER: <br /> Chair Schulz called the meeting to order at 6:35 p.m. in Room 309 of the City-County Building <br /> and made an announcement regarding rules and procedures followed by the Board. <br /> IL APPROVAL OF MINUTES <br /> Motion by Long/Studz to approve the Minutes of the June 12, 2008 Site Inspections and the <br /> Minutes of the June 26, 2008 Public Hearing of the Dane County Board of Adjustment. <br /> Motion carried, 4—0. <br /> III. PUBLIC HEARING FOR JULY 24, 2008 APPEALS <br /> 1. Appeal 3532. Appeal by Daniel Henning et al. for a variance from minimum required setback from <br /> road as provided by Section 10.17(3), Dane County Code of Ordinances, to permit addition to existing <br /> agricultural building as constructed at 42 Muller Road in the SE 1/4 SE1/4, Section 12, Town of York. <br /> COMMUNICATIONS: Town of York: 06/10/2008 Acknowledgment; 07/16/2008 letter: "Approved" at <br /> July 14, 2008 Town Board meeting. <br /> VARIANCE REQUESTED: Purpose: Allow addition to existing calf shed as constructed. <br /> Setback from Road Variance: <br /> Minimum setback from right-of-way required: 30 feet. <br /> Actual Setback from right-of-way: 19 feet. <br /> VARIANCE NEEDED: 11 feet. <br /> IN FAVOR: Daniel Henning, Waterloo, WI —owner. <br /> OPPOSED: None <br /> ZONING ADMINISTRATOR'S RECOMMENDATION: None <br /> Motion: Long/Reynolds to grant 11 foot variance from minimum 30 foot setback from Muller Road <br /> right-of-way to allow addition to existing calf shed as constructed. <br /> Finding of Fact: <br /> 1. Daniel Henning and Ruth & Elmer Henning Life Estate are the owners of an 80 more or less acre <br /> dairy farm (A-1 EX Exclusive Agricultural zoning). A farmhouse and agricultural buildings have <br /> access onto Muller Road. An existing 15.4'x28' calf shed was located about 34 feet from the north <br /> Muller Road right-of-way, next to the existing farm driveway. <br /> 2. Town of York officials and a Dane County Zoning Inspector noticed that a 14'x28' addition to the <br /> shed, built in November 2007, appeared to extend into the minimum 30 foot setback from the road <br /> right-of-way. Because it was an addition to an existing agricultural building, it did not require any <br /> Dane County Zoning Permit. A survey confirmed that the building was only 19 feet from the road <br /> right-of-way and 52 feet from the centerline. <br /> 3. Henning stated the road in front of the shed was widened about 30 years ago, bringing it closer to <br /> the shed and an adjacent fenced feedlot. The addition to the shed does not extend closer to the <br /> road than the existing fence. <br /> 4. Henning told the Board he could not add to the rear of the shed because of the slope of the <br /> existing shed roof, and because it would obstruct another shed's entrance and encroach too close <br />
