I f:TITION NO. 3/ . 7 <br /> ORDINANCE AMENDMENT 3/4.7 1983-84 <br /> CREATING ADDITIONAL CONDITIONAL USES IN CERTAIN DISTRICTS <br /> The County Board of Supervisors of the County of Dane does ordain as <br /> follows: <br /> I . All references herein to chapter , section and subsection numbers are <br /> to those of the Dane County Code of Ordinances unless expressly <br /> stated otherwise . <br /> II . Section 10. 01 (19m) is created to read as follows: <br /> • (19m) "Dependency living arrangement" means a physical arrangement <br /> of a dwelling unit in such a fashion that separate living spaces are <br /> created within the dwelling unit for the sole purpose of allowing a <br /> dependent relative of the owner to live in the secondary living area <br /> while the owner and his or her family reside in the principle living <br /> area. The secondary living area may contain a bath and limited <br /> kitchen facilities which permit a degree of independence. <br /> III . Section 10 . 05 (2) (g) is created to read as follows: <br /> (n) Dependency living arrangements. <br /> IV. Section 10. 09 (2) (2) is created to read as follows: <br /> (2) Dependency living arrangements. <br /> V. Section 10 . 12 (2) (m) is created to read as follows: • <br /> (1) Dependency living arrangements . <br /> VI . Section 10. 123 (4) (a) is amended to read as follows: <br /> (a) Single family dwellings or mobile homes occupied by <br /> parents or children of the farm operator , and including <br /> dependency living arrangements. <br /> VII . Section 10. 255 (2) (h) 1. is created to read as follows: <br /> 1. In addition to such other conditions as the Committee may <br /> impose upon any conditional use, in the case of dependency <br /> living arrangements, the committee shall require as a condition <br /> of approval that the use shall be discontinued at the time that <br /> the dependent relative ceases to reside in the secondary living <br /> area. At that point, the owner shall remove any separate <br /> kitchen facilities which have been installed. In no event <br /> shall the space so created be used by other than a dependent <br /> relative and it shall not be used for general rental <br /> purposes . The committee may, if it so desires, require the <br /> owner to record deed restrictions implementing these additional <br /> restrictions and such deed restrictions may be required to run <br /> in favor of the county, the town and adjacent landowners. <br /> [EXPLANATION: This series of amendments gives the Zoning Committee <br /> authority to grant conditional uses in Residence, Rural Residence. and <br /> Agricultural Districts for the purpose of allowing dependent relatives of <br /> home owners the opportunity to live in separate living areas of a principle <br /> dwelling unit.
