D.L.A.S should not be limited to relatives of the owner. There are people <br /> and families who are willing to help others and they should not be restricted <br /> from doing so. <br /> 2) . The use shall be discontinued when a D.L.A. is terminated unless subsequent <br /> use of the facility by a new dependent is commenced. <br /> 3) . The limited kitchen shall be removed when the use is terminated unless the <br /> dependent living facility is converted to a recreational area. <br /> RE: a) . Applicant is forewarned that kitchen is limited and temporary. <br /> This should alleviate the installation and expense of a substan- <br /> ' tive facility. <br /> b) . Conversion to a recreational room can be planned beforehand and <br /> require only minor, if any, alteration. The conversion should be <br /> subject to zoning permit to provide a record of the change and re- <br /> sulting compliance. <br /> 'c) . Leaving the D.L.A. intact, with kitchen, is an invitation to rent <br /> the facility to the general public. This could create an enforce- <br /> ment nightmare because the violation would more than likely be dis- <br /> closed by neighbor complaint, after the fact. <br /> Such a situation could lead to an application for R-3A, Duplex, to <br /> provide compliance on an in-place existing, duplex use perhaps lo- <br /> cated in an area where duplexes are not desired. <br /> If an individual is desirous of providing a D.L.A. which could be <br /> utilized as a premanent separate living facility an application for <br /> appropriate (R-3A) zoning should be submitted to provide the opportu- <br /> nity for review and approval prior to everything being constructed. <br /> 4) . The Conditional Use Permit should always provide that the D.L.A. may not be <br /> used for general rental purposes. <br /> 5) . The Conditional Use Permit should not be transferable to a subsequent owner. <br /> 6) . The Conditional Use Permit should be recorded to provide the pertinent infor- <br /> mation to realtors, mortgage companies, and prospective buyers. <br /> AD-75 <br />
