Soon the drinking age in <br /> this state will be 19 years and, as a result, this establishment <br /> will not be frequented by individuals of younger age. I attach <br /> hereto for your review, a letter from Mr. Wosepka which provides <br /> some basic information concerning vandalism and includes <br /> recommendations on what a business establishment can do <br /> to eliminate or minimize the opportunity for the commission <br /> of vandalism. <br /> I believe the facts of this situation as reported in Mr. <br /> Wosepka' s letter will lead the committee to believe that the <br /> establishment of this particular business will not be detrimental <br /> to the use, value or enjoyment of Mr. Pechmann ' s property through <br /> any measurable increase in vandalism. I also hasten to point out <br /> that the risk of vandalism is one which can be insured against <br /> for a modest premium. We believe that vandalism is a risk <br /> that all businesses must face and that reasonable businessmen <br /> insure against that kind of a risk. We suspect that Mr. Pechmann <br /> may already have such insurance in force. <br /> We take serious issue with the assertions made by the <br /> attorney for Mr. Pechmann that the stretch of U.S . Highway <br /> 51 from Acker Road to the Town of Windsor line ( a distance <br /> of approximately 2 . 02 miles) has experienced an unusually high <br /> number of accidents. <br /> We have consulted with John Volker, an accident analysis <br /> engineer employed by the Wisconsin Department of Transportation, <br /> and have learned that during the year ending 1983 , only 20 <br /> property damage accidents occurred over this stretch of highway <br /> including 8 injuries and no fatalities. This equates to <br /> 399 accidents per 100 ,000 ,000 miles traveled in this section <br /> of highway. The state wide average, we are informed by Mr. <br /> Volker, is 718 accidents per 100 ,000 ,000 miles. As you can <br /> conclude from these figures , not only is this stretch of <br /> roadway not infamous for the number of accidents that have <br /> occurred thereon, but it is actually significantly safer than <br /> the average comparative roadway in this state. <br /> My client wishes the committee to know that he is as much <br /> concerned about the safety and welfare of persons traveling <br /> this highway as is Mr. Pechmann.
