AGREEMENT AND RESTRICTIONS <br /> This Agreement entered into on the Z> day of Ag176. --- <br /> 1984 , between CHESTER W. HOWARD (hereinafter called Property <br /> Owner ) and the Town of Middleton (Middleton, County of Dane, <br /> State of Wisconsin) . <br /> 1 . Chester W. Howard is the owner of a property located <br /> in the Town of Middleton, Wisconsin, more properly described as <br /> part of the SE 1/4 SE 1/4 of Section 17, Town of Middleton, <br /> described as follows: <br /> Part of Lot #2, CSM 3977, as recorded in Volume 16 of <br /> Certified Surveys , Page 265, described as follows : <br /> Commencing at the Southwest corner of said Lot #2; thence <br /> south 85° 25 ' 55" E along the Northerly right-of-way line <br /> of Old Sauk Raod, 126 .35 feet; thence N 08° 05 ' E, 50 .00 <br /> feet; thence S 81° 55 ' E, 96 .00 feet; thence S 08° 05 ' <br /> 40.00 feet; thence N 81° 55 ' W, 46 .00 feet ; thence S 08° <br /> 05 ' W, 10 .00 feet to the point of beginning. <br /> 2 . That the Property Owner has requested that that <br /> portion of land described above be rezoned to a B-1 District . <br /> 3 . The building and land surrounding the proposed <br /> rezoning are currently owned by Chester Howard and are <br /> currently zoned A-1 and LC-1 , Agriculture District . <br /> 4 . Dane County has notified the Property Owner that the <br /> site must be rezoned to a B-1 District, in order to permit the <br /> use of the premises for a business office . <br /> 5 . Property Owner has applied for the change in zoning <br /> from A-1 to B-1 for the premises . <br /> 6 . The Town of Middleton has considered the zoning change <br /> and will approve such change only if the B-1 District limits <br /> the use to that of a business office, excluding all other uses <br /> not provided for under the A-1 District, and applies only to <br /> the property identified above . <br /> In consideration of the above , the parties agree as follows : <br /> 1 . Property Owner will petition Dane County to rezone the <br /> • <br /> parcel described above to B-1 District use restricted to that <br /> of office space and excluding all the other uses permitted <br /> under a B-1 District . <br /> 2 . Property Owner will be in complete control of the <br /> rezoned parcel and shall use the parcel as business offices , <br /> which shall be operated on the premises and agrees that they <br /> will not, except as hereinafter set forth , sell , transfer , <br /> lease or in any way change the use of said parcel to other than <br /> business offices . <br />
