Dane County Board of Adjustment Minutes Page 1 of 9 <br /> August 28,2008 <br /> NOTE: These minutes reflect the notes of the recorder and are subject to correction and approval at a <br /> subsequent meeting of the Committee. <br /> DANE COUNTY BOARD OF ADJUSTMENT <br /> MINUTES OF THE AUGUST 28, 2008 MEETING <br /> MEMBERS PRESENT: Carlton Hamre, Al Long, Steven Schulz, Sue Studz. <br /> Note: Board Member Glenn Reynolds was excused. <br /> OTHERS PRESENT: Zoning Administrator Roger Lane, Assistant Zoning Administrator Kris Schutte, <br /> Assistant Dane County Corporation Counsel Dave Gault. <br /> I. CALL TO ORDER: <br /> Chair Schulz called the meeting to order at 6:34 p.m. in Room 309 of the City-County Building <br /> and made an announcement regarding rules and procedures followed by the Board. <br /> II. APPROVAL OF MINUTES <br /> Motion by Long/Studz to approve the Minutes of the July 10, 2008 Site Inspections and the <br /> Minutes of the July 24, 2008 Public Hearing of the Dane County Board of Adjustment. <br /> Motion carried, 3—1, Hamre: Abstain. <br /> III. PUBLIC HEARING FOR AUGUST 28, 2008 APPEALS <br /> 1. Appeal 3536. Appeal by Patricia A. Lynn Revocable Trust (Mike Lynn, agent) for variances from <br /> A) minimum required lot width at the building setback line, B) minimum required lot area, C) maximum <br /> allowable lot coverage, and D) minimum averaged setback from the Ordinary High Water Mark, as <br /> provided by Sections 11.03(1) & (2) and 10.05(4) & (5), Dane County Code of Ordinances, to permit <br /> proposed removal and replacement of a single-family residence on an existing substandard lot in the <br /> Shoreland District, at 2942 Waubesa Avenue, being Lot 8, Block 3, Waubesa Beach Second Addition, <br /> Section 05, Town of Dunn. <br /> COMMUNICATIONS: <br /> • 07/28/2008 Town of Dunn Acknowledgement. <br /> • 08/25/2008 Dunn Town Board "recommends approval." Town Clerk Rosalind Gausman included <br /> the following comment in her letter: "The Board usually makes the approval conditioned upon [the <br /> property owners] keeping the surface water runoff generated on this property from going onto the <br /> adjacent properties. They overlooked that until later in the meeting and the Lynns had already left, <br /> so it was not included in the Town Board action. Please consider if it would be beneficial to <br /> include this condition in your action if you approve this appeal." <br /> • 08/19/2008 Letter from Cami Peterson, Water Regulation and Zoning Specialist, WDNR, <br /> recommending denial of the variances. Chair Schulz asked Schutte to read the letter into the <br /> record. <br /> VARIANCES REQUESTED: Purpose: To permit proposed removal and replacement of a single- <br /> family residence on an existing substandard lot in the Shoreland District <br /> A) Lot Width Variance <br /> Minimum lot width at building setback line required: 100 feet. <br /> Actual lot width: 43.3 feet as platted; 43.52 feet as surveyed — slightly more at building <br /> setback line. <br /> VARIANCE NEEDED: 56.7 feet as platted; 56.48 feet as surveyed. <br /> B) Lot Area Variance: <br /> Minimum lot area required: 15,000 SF. <br /> Actual lot area: 8,200 more or less SF. <br /> VARIANCE NEEDED: 6,800 more or less SF <br />
