1. Appeal 3536. Appeal by Patricia A. Lynn Revocable Trust (Mike Lynn,
agent) for variances from A) minimum required lot width at the building
setback line, B) minimum required lot area, C) maximum allowable lot
coverage, and D) minimum averaged setback from the Ordinary High
Water Mark, as provided by Sections 11.03(1) & (2) and 10.05(4) & (5),
Dane County Code of Ordinances, to permit proposed removal and
replacement of a single-family residence on an existing substandard lot in
the Shoreland District, at 2942 Waubesa Avenue, being Lot 8, Block 3,
Waubesa Beach Second Addition, Section 05, Town of Dunn.
Lynn submitted a revised plan complying with minimum averaged setback from
OHWM of 43.6 feet. He had previously revised the building plans to comply with
maximum 30% lot coverage.
Motion Hamre/Studz to grant variances from minimum lot width and minimum lot
area with Condition as requested by Town of Dunn to keep surface water run-off
generated on this property from going onto the adjacent properties. Carried 4-0.
NOTE: Lynn would like to get a Zoning Permit (ZP) as soon as possible, but he
must obtain the Town Driveway Permit first. Also, his builder stated that Lynn
has already applied for the Shoreland Erosion Control Permit (SECP). The
SECP may need to be amended to show the revised location of the proposed
house, and to include measures to keep runoff from adjacent properties, to
satisfy the Condition of approval. Lynn must provide a copy of the revised SECP
plan for review by Schutte or Lane to verify compliance with the Condition before
the ZP may be issued.
CONDITION MET 09/08/2008: SEE EMAIL 09/04/08 FROM ENGINEER AND
EROSION CONTROL PERMIT SITE PLAN 09/08/2008 - KLS
