A <br /> Zoning Cammittee -- April 10, 1984 <br /> If the Judge had intended that a zoning change would be necessary to complete the <br /> transaction determined in Court, he would (obviously, I think) not have authorized <br /> the Order describing the separate parcels of real estate. In reality, a zoning <br /> change would not be required once the separate legal entities had been clearly <br /> established. <br /> -ri— dtV(Sioti, o.{. doavcc31S <br /> was a decision the Court made in total -- the decision was to equalize and <br /> divide the joint property. Each of the parcels adds to the sum of the whole Court <br /> decision. <br /> I think a very brief history of recent farm takings should be mentioned for the <br /> record and perhaps throw some significant background light on t�heo 1Current dilemma. <br /> The State condemned land for the new highway right-of-way for 18 and 151. This <br /> action severely altered our farming potential -- it had been a dairy farmlin the <br /> family, for 100 years. The State action led to the demise of the dairy. The acres <br /> could no longer support the dairy. There are now three paralleling roads through <br /> the south side of the farm and where we formerly had two access crossings we now <br /> have none. The improvements are on the north side of the highway -- the only way <br /> to reach the south side was around the^roadS% <br /> The three paralleling roads are the old 18 and 151 road; the 100-foot rail corridor <br /> which will be a bike trail; and, the new 18 and 151 right-of-way approaching the <br /> intersection at Highway 78 (so the taking is wider in the approach to the intersection) . <br /> The new road goes diagonally through the land from the northwest to the southeast <br /> and in the process left a narrow, triangular sliver`-bf little or no use for farming. <br /> As I said, it destroyed acres necessary for our farming operation. <br /> In the taking, the appraisal by the State was low and we were advised (by a <br /> representative of the District DOT, Henry Golbach) to get another appraisal. We <br /> obtained LeRoy Sauer who came in with a higher value but because of many obvious <br /> discrepancies in both of these appraisals, I hired Thomas Wycrore for an independent <br /> appraisal. <br /> I have a copy of each of the appraisals with me as well as a list of the errors in <br /> the first two appraisals substantiating the need for the third. <br /> - 2 - <br />
