The reason <br /> for this is that the territory within the plat has been <br /> annexed to the City of Madison. That annexation, as you know, <br /> is being contested by the Town of Middleton. Section <br /> 236 . 10 (1) (a) of the Wisconsin Statutes provides that where "a <br /> plat is within an area, the annexation of which is being <br /> legally contested" it is entitled to be recorded if it has the <br /> approval of "the governing bodies of both the annexing <br /> municipality [Madison] and the town from which the area has <br /> been annexed [Middleton] " . The statute does not necessitate <br /> county approval under the circumstances which exist here.
