Rendall : <br /> I am sure you need no advice from me as to the courses of action <br /> available to the committee respecting the most recent Rowley <br /> petition. Since the town board disapproved the requested zoning <br /> change , as I. understand Wis . Stat . §59 . 97 (5) (e)3 . the committee <br /> may not recommend approval of the petition without amendment , but <br /> may only recommend approval with change or recommend disapproval . <br /> We assume the petition will not be amended. If that is the case <br /> the options available to the county board are set forth in <br /> subd. 5 : <br /> "Upon receipt of such agency report the county board <br /> . . may deny the petition for amendment , or it may <br /> refuse to deny the petition as recommended by the <br /> agency in which case it shall rerefer the petition to <br /> the agency with directions to draft an ordinance to <br /> effectuate the petition and report the same back to the <br /> county board which may then adopt or reject such <br /> ordinance . " <br /> Thus , if the committee is compelled , by reason of the disapproval <br /> of the town board , to recommend disapproval , that recommendation <br /> may be overridden by the county board which must then rerefer the <br /> petition to your committee to draft the appropriate ordinance and <br /> report the same back to the county board. The county board may <br /> then adopt or reject such ordinance . <br />
