• <br /> U n rAGE 1111 <br /> DECLARATION OF COVENANTS, RESTRICTIONS AND EASEMENTS <br /> TO THE <br /> SOUTH SLOPE ADDITION TO THE AMERICAN HERITAGE SUBDIVISION <br /> BEING A PART OF THE TOWN OF COTTAGE GROVE, DANE COUNTY, WISCONSIN <br /> Whereas, Walter D. Olson and Walter J. Olson are the owners and developers of this sub- <br /> division; and on behalf of themselves, their heirs, successors and assigns, the under- <br /> signed do hereby declare the following: <br /> 1. So long as the developers hold title to any parcel in this plat, no building <br /> shall be erected or placed upon any individual parcel until that site owner, or <br /> agent for, shall provide to the developers a like kind set of plans. Said plans <br /> shall be drawn to a scale as to be legible and typical of the industry standards, <br /> and shall depict the four (4) elevations, the floor and plot plan. The developer <br /> shall approve or disapprove the plans within fourteen (14) days of 'receipt. The <br /> principal criteria the developer shall use in making the judgment are: <br /> a. Improvements which enhance or protect property values, not limited to <br /> structure size, exterior style, physical orientation on site, and as <br /> such factors interrelate with adjoining and nearby property. <br /> b. Seek to accommodate neighborhood needs and interests. <br /> c. Preserve existing trees and water drainage ways where possible. <br /> d. Encourage physical design of improvements and site landscaping such <br /> that individual property owners may receive the benefits as are <br /> afforded the passive solar orientation the plat. <br /> 2. Public utility service extensions shall be underground. <br /> 3. Single family structures shall be set back from the front lot line at least forty <br /> (40) feet unless waived by the developer in writing. <br /> 4. All notations as provided on the plat' documents are accepted herein. <br /> 5. All outbuildings shall be constructed in a workmanlike manner and shall be so <br /> maintained thereafter; further: <br /> a. On Outlots 1, 2, 3, 4, and 5, no animal house or shelter shall be located <br /> within 100 feet of the front lot line or within 100 feet of the street on a <br /> side yard if said side yard is on the street side of a corner lot, unless <br /> said is waived in writing by the developer. <br /> b. No pigs shall be kept on any of the Outlots. <br /> c. Outlots Two and Four shall not be used for stockyards, auction barns, stock <br /> or livestock trucking services, nor for bulk mixing or blending of feed, <br /> seed or fertilizers, nor sales or service of methane generating or alcohol <br /> distilling equipment. <br /> 6. All building materials, trash and junk, inoperable vehicles or other equipment in <br /> need of repair; shall be stored within enclosed structures if they are to remain <br /> on the property for longer than ninety days. <br /> a. Outlots Two and Four shall further be required to provide at least an eight <br /> foot high privacy screen along the northerly side of that portion of the <br /> site that any machinery or man-made materials are stored outside of an <br /> enclosed structure. <br /> 7. Invalidation of any of these covenants and restrictions by governmental code, rule <br /> or court shall not affect any of the other provisions which shall remain in <br /> effect for a period of twenty years from the date of recording of this document. <br /> a. Amendments may he made by a simple majority vote. The developer must <br /> consent to any changes in writing. Each parcel shall have a single <br /> vote by the (or an) owner thereof. All the votes taken shall be <br /> recorded along with the amendment and consent statement of the <br /> developer before the change shall CCbecome CCeffective. <br /> IN WITNESS WHEREOF, said Walter D.
