(2 <br /> L <br /> DECLARATION OF CIJUENANTS ,RESTRICTIONS AND EASErENTS a. <br /> TO THE <br /> SOUTH SLOPE ADDITION TO THE AItERICAN HERITAGE SUBDIVISION <br /> BEING A PART OF THE TOWN OF COTTAGE GROVE ,DANE COUNTY ,WISCONSIN <br /> Whereas ,Walter D. Olson and Walter J. Olson are the owners and developers <br /> of this subdivision; and on behalf of themselves , their heirs , successors <br /> and assigns ,the undersigned do hereby declare the following : <br /> 1 .So long as the developers hold title to any parcel in this plat, no <br /> building shall be erected or placed upon any individual piteel until <br /> that site owner , or agent for, shall provide to the developers a like <br /> kind set of plans. Said plans shall be drawn to a scale as to be legi- <br /> ble and typical of the industry standards , and shall depict the four(4) <br /> elevations, the floor and plot plan. The developer shall approve or <br /> disapprovethe plans within fourteen(14) days of receipt. The principal <br /> criteria the developer shall use in making the judgement are : <br /> a. lmprovements which enhance or protect property values , not limit- <br /> ed to structure size , exterior style ,physical orientation on site , <br /> and as such factors interrelate with adjoining and nearby property. <br /> b.Seek to accomodate neighborhood needs and interests. <br /> c.Preserve existing trees and water drainage ways where possible. <br /> d.Encourage physical design of improvements and site <br /> landscaping such that individual property owners may receive the <br /> benefits as are afforded the passive solar orientation of the plat. <br /> 2. Public utility service extensions shall be underground. <br /> 3. Single family structures shall be set back from the front lot line <br /> at least forty (40) feet unless waived by the developer in writing. <br /> 4. All notations as provided on the plat documents are accepted herein. <br /> All outbuildings shall be constructed in a workmanlike manner and <br /> shall be so maintained thereafter; further : <br /> 3.0n Outlots 1 ,2,3,4 ,and 5, no animal house or shelter shall be <br /> located within 100 feet of the front lot line or within 100 fee <br /> OF the street on a side yard if said side yard is on the street\'t <br /> side of a corner lot,unless said is waived in writing by the <br /> developer. <br /> b.No pigs shall be kept on any of the Outlots. I <br /> ‘ <br /> • (3Outlots Two and Four shall not be used for stock yards , auction � 0, <br /> barns , stock or livestock trucking services,nor for bulk mixin 1 <br /> . or blending of feed, seed or fertilizers. 1/AAdue (.;e4;r:Ag17.4 w4/cc/1kf y;,�.` <br /> 41 <br /> All building materials , trash and junk, inoperable vehicle or other <br /> equipment in need of repair;shall be stored within enclosed struct- <br /> u es if they are to remain on the property for longer than ninety days. <br /> Outlots Two and Four shall further be required to provide at <br /> least an eight foot high privacy screen along the northerly side <br /> of that portion of the site that any machinery or man-made mater- <br /> ials are stored outside of an enclosed structure. <br /> 7. Invalidation of any of these covenants and restrictions by govern <br /> mental code ,rule or court shall not affect any of the other provis- <br /> ions which shall remain in effect for a period of twenty years from <br /> the date of recording of this document. <br /> a.Amendments may be made by a simple majority of the property owners, <br /> one vote per parcel , and recording said votesand amendment together, <br /> During the first ten years from the date herebfi the <br /> developer must consent to such changes in writing. <br /> IN WITNESS WHEREOF,said Walter D.
