Even if that isn't true <br /> there are problems with extending the road, a cul-de -sac would <br /> have to be established. The location of the cul-de-sac would <br /> put Mr. Statz's house in the road right of way. If something <br /> happen to Mr. Statz's house, he would not be able to build on the <br /> existing foundation but would have to move the house out of the <br /> road right of way. The cost of the road would be more then what <br /> he is getting for the land and being on a fixed income, he is in <br /> no position to be paying for town road improvements. <br /> This easement will be no different, then one farmer giving another <br /> farmer the right to cross his land to get to a certain field. Or <br /> giving easements to power companys to erect and maintain power <br /> poles, which means they can cross that person's land to maintain <br /> the power poles. If Mr. statz was selling forty acres to another <br /> person and it didn't front on a public road there would be nothing <br /> illegal about Mr. Statz giving an easement to cross his land to <br /> get to that particular forty acres. The parcel he is creating for <br /> his son is a legal parcel and just because a easement is used to <br /> get to the land doesn't make that easement illegal or different <br /> from any of the situations above, or different from any easement <br /> giving the right for one person to cross another person's land no <br /> matter what its used for. <br /> If any of the board members have any questions or if they wish my <br /> presents at the working meeting, I would be glad to answer any <br /> questions they have or attend the working meeting.
