That the establishment of the conditional use will not impede the normal <br /> and orderly development and improvement of the surrounding property for <br /> uses permitted in the district. <br /> 4. That adquate utilities, access roads, drainage and other necessary site <br /> improvements have been or are being provided. <br /> 5. That adequate measures have been or will be taken to provide ingress and <br /> egress so designed as to minimize traffic congestion in the public streets, <br /> and <br /> 6. That the conditional use shall conform to all applicable regulations of the <br /> district in which it is located. <br /> CONDITIONS AND GUARANTEES. Prior to the granting of any conditional use, the <br /> zoning Committee may stipulate such conditions and restrictions upon the <br /> establishment, location, construction, maintenance, and operation of the <br /> conditional use as deemed necessary to promote the public health, safety, and <br /> general welfare of the community, and to secure compliance with the standards <br /> and requirements specified in above (1-6) . In all cases in which conditional <br /> uses are granted, the committee shall require such evidence and guarantees as <br /> it may deem necessary as proof that the conditions stipulated in connection <br /> therewith are being and will be complied with. <br /> To highlight our concerns, we have adopted 15 points we feel need to be addressed if <br /> a Conditional Use Permit is requested. <br /> 1. Consolidated to post a bond to cover potential damage to surrounding wells and <br /> ground water in the amount of two million dollars. <br /> 2. Herman Erb to insure the premium of the bond if Consolidated goes out of <br /> business or fails to cover the bond. This bond will cover a 5-year residual <br /> period after the hot mix plant vacates or dismantles. <br /> 3. No gravel to be hauled into the plant from outside the 35-acre parcel <br /> (including adjacent property) . <br /> 4. No additional rezoning of Herman Erb farm will be allowed while the hot mix <br /> plant is on that property. <br /> 5. Excavation to be a minimum of three feet above the low water level per code <br /> (Sub Sec. 10.126 (2) A-3) . <br /> 6. Before approving site, Consolidated must provide a blue print of site showing <br /> where the roads, plant, and berm holding ponds will be located per code (Sec. <br /> 10.126 (2) (a) 2) . This must be approved by local residents. <br /> 7. A road must be built directly to the plant from Highway T by Consolidated and <br /> be maintained by them. No Town of Sun Prairie taxes shall be used for <br /> maintaining the road. <br />
