Since Consolidated will be pumping a considerable amount of water each month, <br /> if the water level gets to a dangerous level with local wells failing, <br /> Consolidated will have to stop pumping water. <br /> 10. Need clarification of how holding ponds will be cleaned and where the residue <br /> will go. <br /> 11. No fueling or storage of equipment will be allowed on the site. <br /> 12. Hours of operation shall be limited to 7:30 a.m. to 5:00 p.m. , Monday - <br /> Saturday. <br /> 13. When hot mix plant ceases to operate, it will be the responsibility of Herman <br /> Erb to undertake a reclamation program to put the land back to its natural <br /> state or to restore it to productive agricultural use. <br /> 14. There shall be four ground water monitoring wells located at the perimeter of <br /> the plant. <br /> 15. There shall be periodic inspection of the site to verify operating conditions. <br /> While most of these are addressed in the Dane County Code of Ordinances, some <br /> are in addition to that. <br /> Without full knowledge of the impact of Zoning Change #3473 and Conditional Use <br /> Permit #446, the Zoning Committee approved it and forwarded it on to the Town of Sun <br /> Prairie Board for approval or defeat. They had 40 days to act as of August 5, <br /> 1985. At 8:45 p.m. , August 8, 1985, the three-man town board voted to approve the <br /> zoning change. After considerable pressure from concerned taxpayers, at 3:20 a.m. , <br /> August 9, 1985, the board rescinded its earlier action and agreed to review the <br /> change further. <br /> We understand a tentative date of August 27, 1985, has been set to discuss the <br /> Conditional Use Permit. Since there are many unanswered questions and the 40 days <br /> the town has to veto the zoning change will not have passed, we feel that the August <br /> 27 meeting is quite premature. <br /> This issue has attracted considerable media exposure since it appears the interests <br /> of Consolidated Paving have been put ahead of the interests of taxpayers in Sun <br /> Prairie. Because the Sun Prairie Town Board is not taking the considerations of the <br /> people who elected them into office, we feel that Sub Section 10.255 (2) (g) is not <br /> being complied with and, therefore, request that a new public hearing be held per <br /> Sub Sections 10.255 (2) (e) (f) . <br /> We feel very strongly that a new public hearing to address the concerns and county <br /> ordinances is absolutely necessary before a final decision can be rendered. We <br /> would suggest this be held after the DNR visits the site August 23. We would again <br /> urge you to have members of the County Zoning Committee visit the site at that times <br /> as well.
