•
/g", (cie
8- OFFICE OF THE
'- 1? CORPORATION COUNSEL
September 2, 1987
Betty Faulkner S P 0 3 1981
3972 Ruth Ct.
McFarland, WI 53558
Dear Ms. Faulkner :
You indicated in our conversation earlier this week that you
wished to receive further information relative to an appeal of
the Conditional Use Permit granted to Earl Pottinger. This
letter will summarize the county ordinances relative to an
appeal; I also enclose a copy of the ordinance that applies.
The appeal of a grant or a denial of a Conditional Use
Permit is to the full county board. Reversal takes a 3/4ths vote
or in the case of Dane County, 31 members of the 41 member
board. This means that the Conditional Use Permit granted to Mr .
Pottinger in this case will stand unless 31 county board
supervisors vote to reverse the Ag-Zoning Committee ' s action. .
Further, any such vote is subject to the County Executive ' s veto
power .
The appeal can be taken only by the property owner directly
affected (Mr . Pottinger in this case) or by the owners of half or
more of all the land located within 300 feet of the subject
property. This last provision is the one applicable to your
circumstance. The statement of appeal must specify which
findings of the Ag-Zoning Committee are objected to. The appeal
must be filed with the zoning administrator within 30 days of the
•
Ag-Zoning Committee' s action. You indicated that the Ag-Zoning
Committee acted on August 24, 1987; the appeal will then have to
be filed no later than 4 :30 p. m. on September 23, 1987 . The
zoning administrator is William Fleck; his mailing address is
Room 116 City-County Building, 210 Martin Luther King, Jr . ,
Blvd. , Madison, WI 53709.
Once the zoning administrator receives the appeal, it will
transmit it to the county board. The county board will then
schedule a hearing on the matter . Each person who signs the
petition should also indicate his or her address on the petition
419 City-County Building, 210 Monona Avenue, Madison, Wisconsin 53709 608/266-4355
