This <br /> letter will summarize the county ordinances relative to an <br /> appeal; I also enclose a copy of the ordinance that applies. <br /> The appeal of a grant or a denial of a Conditional Use <br /> Permit is to the full county board. Reversal takes a 3/4ths vote <br /> or in the case of Dane County, 31 members of the 41 member <br /> board. This means that the Conditional Use Permit granted to Mr . <br /> Pottinger in this case will stand unless 31 county board <br /> supervisors vote to reverse the Ag-Zoning Committee ' s action. . <br /> Further, any such vote is subject to the County Executive ' s veto <br /> power . <br /> The appeal can be taken only by the property owner directly <br /> affected (Mr . Pottinger in this case) or by the owners of half or <br /> more of all the land located within 300 feet of the subject <br /> property. This last provision is the one applicable to your <br /> circumstance. The statement of appeal must specify which <br /> findings of the Ag-Zoning Committee are objected to. The appeal <br /> must be filed with the zoning administrator within 30 days of the <br /> • <br /> Ag-Zoning Committee' s action. You indicated that the Ag-Zoning <br /> Committee acted on August 24, 1987; the appeal will then have to <br /> be filed no later than 4 :30 p. m. on September 23, 1987 . The <br /> zoning administrator is William Fleck; his mailing address is <br /> Room 116 City-County Building, 210 Martin Luther King, Jr . , <br /> Blvd. , Madison, WI 53709. <br /> Once the zoning administrator receives the appeal, it will <br /> transmit it to the county board. The county board will then <br /> schedule a hearing on the matter .
