The public notice <br /> provision in the ordinance does not necessarily mean that the <br /> county board will publish a notice of the hearing in the <br /> newspapers; a simple posting in a public place such as the City- <br /> County Building will meet this requirement. <br /> Once the public hearing of the appeal is completed, the <br /> county board will vote on the matter. This may or may not be <br /> same date as the public hearing. After the vote, if it is in <br /> favor of reversing the Ag-Zoning Committee' s action, the county <br /> executive will have a number of days (usually until the next <br /> county board meeting) to decide whether to veto the county <br /> board's action. <br /> In addition to the appeal procedure set forth in the <br /> ordinance, there is case law in Wisconsin which stands for the <br /> proposition that a party affected by the grant of a Conditional <br /> Use Permit can appeal the grant to the Board of Adjustment. ■ <br /> Should you elect to proceed along those lines, the appeal notice <br /> should be sent to the Zoning Administrator in the same manner as <br /> with an appeal under the ordinance. There may be a fee for an <br /> appeal to the board of adjustment; please check with Mr. Fleck at <br /> 266-9083. I express no opinion as to whether both appeals can be <br /> taken, whether at the same time or sequentially, nor do I know <br /> the timing required for an appeal to the board of adjustment, , <br /> other than it must be "taken within a reasonable time" as stated <br /> in sec. 10.26, D.
