COUNTY OF DANE )
STATE OF WISCONSIN)
Petition for Appeal of Ag-Zoning Committee Decision Rendered
on August 25, 1987 on C.U.P. #610
We the undersigned respectfully appeal to the Dane
County Board of Supervisors to set aside the approval of C.U.P.
#610, on the grounds that not all the standards were complied
with:
#1 does not meet nor comply with ILHR #82.10 Basic
Plumbing Principles. "Every building intended for
human occupancy must be provided with an adequate,
safe & potable water supply" . This house at #2947
Camp Leonard Road has no running water and is served
by an outhouse. ILHR #83.01 Purpose "Every building
intended for human habitation shall be provided with
a properly functioning system for treatment & disposal
of domestic waste. Neither of which has been complied
with. At the time the sanitary sewer was put through
to us we were compelled to hook up or use existing
Septic systems. This has neither, therefore is
detrimental to and endangers public health. These
stipulations were advised by 0.W. Hintz, P.S. Director
of Dane County Environmental Health Division in his
letter of August 10 to Lyman Anderson.
#2 the uses, values and enjoyment of other property
in the neighborhood for purposes already permitted
shall be substantially impaired or diminished by
establishment of this C.U.P. #610. All existing
residences are inhabited as single family residences
and owner occupied . By his own testimony Mr. Pottinger
has no intention of occupying this property and intends
a marina, boat storage, and whatever else once
he obtains this C.U.P. #610.
#4 He does not have adequate utilities (water,& septic) ,
and access road have not been complied with.
#5 Adequate measure have not been taken to provide ingress
and egress so designed as to minimize traffic congestion.
Current tenant has been allowed ingress and egress over
Mr. Trachte 's private drive, a practice not to be continued
due to congestion and inconvenience to Trachte family.
We have been subjected to enough congestion and trespassing
in the area due to the Babcock Boat Launch which Dane County
already gave to the area.
SEP 24 1987.
