DECLARATION OF COVENANTS AND RESTRICTIONS <br /> Kiown all men by these Presents that the undersigned, Virgil W. Christensen <br /> and Alan B. Schwartz, as owners of the real property, now duly platted, <br /> known as Windridge, which Plat is recorded in Volume 51 of Plats, on pages <br /> 48 and 49, as document #1641088 in the Register of Deeds office in Dane <br /> County, Wisconsin, a subdivision in the Town of Oregon, Dane County, <br /> Wisconsin, hereby make the following declarations as to the limitations, <br /> re:tric+lun°, and uses to which the lots in the said plat may be put. <br /> This declaration of restrictions is designed for the purpose of preserving <br /> the value and desirability of the lots in said subdivision as hereinafter <br /> specified. <br /> 1 . All lots shall be used for single family residential purposes and no <br /> structure shall be erected, altered, placed or permitted to remain <br /> upon any lot in said plat other than: <br /> (a) One detached single family dwelling not exceeding 22 stories in <br /> height and one private garage, minimum width of 20 feet, built <br /> as an integral part of the dwelling house, attached thereto or <br /> built within 50' thereof. Said garage shall not exceed 850 square <br /> feet in size. <br /> 2. Each said residential structure shall have the following area of <br /> finished living space, exclusive of basement area, (except raised ranch) , <br /> garages, or porches, whether enclosed or not: <br /> One story - 1 ,200 square feet on main floor. <br /> Raised Ranch - 1 ,400 square feet of which 900 square feet to be on <br /> main level. <br /> Multi level or Tri-level - 1,200 square feet on combined 2 highest <br /> stories. <br /> Story & Half or Two Story - 1 ,400 square feet of which 800 square feet <br /> are on first level. <br /> 3. No one shall dwell in, at any time, or move on to any lot, any type of <br /> temporary housing or structure, basement, garage, trailer home, quonset <br /> hut, tent, shack, barn, or outbuildings, or any part thereof, it being <br /> contemplated that each home shall be of sound construction. <br /> 4. Each residential structure erected shall have its external construction <br /> corrpleted within nine months after date of issuance of building permit, <br /> and shall be fully landscaped within one year from date of issuance of <br /> building permit except for delays in completion due to war, strikes, <br /> or an Act of God. <br /> 5. No fence shall be erected on any lot ahead of the front line of the <br /> dwelling house on such lot unless it be of wood construction not to <br /> exceed three feet in height. <br /> 6. No outbuildings shall be erected on any lot as platted which shall be <br /> ahead of the real line of the dwelling house on such lot. No more <br /> than one outbuilding shall be permitted on each lot. No outbuilding <br /> exclusive of garages, shall exceed 250 square feet in size (current <br /> existing buildings on lot #1 shall be permitted to remain). <br /> 7. Animals: <br /> (a) No animals, livestock, or poultry of any kind other than house <br /> pets, shall be kept or maintained on any part of said property. <br /> (b) Dogs and cats may be kept upon said property, provided that they <br /> are not kept, bred, or maintained for any commercial use or <br /> purpose. <br /> 8. No lot or parcel of land shall be used for storage of any building or <br /> construction or other material or equipment or machinery or other <br /> things not customarily used in the conduct of a private home, unless <br /> said materials or things are actually being used in the construction <br /> or remodeling or repair of the building or other structure on said lot <br /> in conformity with these restrictions. <br /> 9. These covenants and restrictions shall run with the land and be binding <br /> on all persons having an interest in said plat for a period of 20 years <br /> from the date or recording of said plat, and shall automatically be <br /> extended for successive periods of 5 years each, unless the owners of <br /> a majority of lots in the subdivision, prior to the expiration of any <br /> term, shall, by a majority vote duly recorded, agree to amend or repeal <br /> restrictions. <br />
