Furthermore, on behalf of the City Council I requested that the County <br /> deny the Petitioner's request to rezone the subject property to the County's C-2 <br /> District. <br /> Subsequent to the Public Hearing conducted by the Agriculture, Environment and <br /> Land Records Committee the Petitioner, Jack Fountain, met with the City's Plan <br /> Commission to review his proposal to change the zoning of the property located at 1817 <br /> Clarmar Drive. During the meeting Mr. Fountain provided additional information about <br /> how he proposed to use the subject property if the C-2 District zoning were approved. <br /> After a thorough review of the Petitioner's proposed land use the Plan Commission <br /> determined that the use of the property to repair and sell motor vehicles and <br /> recreational vehicles would not be in conflict with the adjacent land uses. However, <br /> the Plan Commission expressed concern that the permitted uses allowed in the C-2 <br /> District were entirely to broad and would provide for certain undesirable future uses <br /> of the subject property. <br /> At that time Mr. Fountain agreed to limit the use of his property through a <br /> Recorded Deed Restriction which would allow his property to be used only for the <br /> following purposes: <br /> 1.) Major repair to motor vehicles <br /> 2. ) Sales of new and used motor vehicles <br /> 3.) Sale of new and used mobile homes, recreational equipment, <br /> and sales and service <br /> With these property restrictions the Plan Commission voted unanimously to <br /> recommend that the City Council reconsider its' original position. On Monday, Octo- <br /> ber 26, 1987 the City Council meeting as a Committee of the Whole considered the <br /> recommendation submitted by the Plan Commission. <br /> After carefully reviewing all of the available information the Committee of the <br /> Whole voted unanimously to formally remove the City's original objections to the <br /> proposed rezoning of the property located at 1817 Clarmar Drive. The removal of the <br /> City's objection to the rezoning is made totally contingent upon Mr. Fountain's <br />
