Miller, Petitioners <br /> We wish to explain the rationale for this rezoning petition . The <br /> attached drawings are intended to help clarify our request. <br /> This case stems from an order of Dane County Circuit Court, Judge <br /> Ingela Bartell, effective in October, 1985, foreclosing a moxrtgage <br /> held by Federated Financial Corp. , Atlanta, Ga. , on approximately <br /> 5 acres within the area we have asked to have rezoned. Subsequently, <br /> the parcel was declared to be in violation of county zoning ordinances <br /> and unsalable . An affidavit making that finding was signed by Mr. <br /> Norbert Scribner, county land division review officer. His 'affidavit • <br /> creates a "cloud" on the title of the parcel, preventing its sale by <br /> discouraging title insurance firms from writing a policy on it. <br /> Since May of 1987 we have occupied the property under a combined <br /> lease and option to buy from Federated Financial Corp. Our purchase <br /> is conditioned on clearing the title so the property :tray be sold and <br /> title insurance issued . We have been advised that this rezoning <br /> proceeding is th e proper method of achieving that objective . <br /> Under our request , as the accompanying illustrations show , relatively <br /> little would change except the narrow strip along the northern edge <br /> of the properties t"at i,,ould change from RH-3 to RH-1 . This is necessary <br /> because a portion of that strip runs across the property we are buying. <br /> (more ) <br />
