uses under both the state code' and the county health code.2 The
Town also adopted a minimum 10 foot spacing requirement.3 Note the
state, county and town ten foot spacing requirement is measured
from "box to box" and protrusions such as awnings or porches are
excluded.¢
Recent inspections of the mobile home park revealed that 61
long existing mobile homes are located closer to each other than
the 10 foot minimum. To comply, most of the 61 mobile homes need
only be moved a matter of inches. The property owner and the Town
have been working together to make a plan to relocate the mobile
homes to satisfy the minimum 10 foot requirement. Your applicant
' "Any modification of a mobile home park which existed prior
to 1962 relating to the size of basic units, the separation of
basic units or the placement of basic units on a lot in
relationship to streets and other buildings shall be permitted by
the department * * *.11 See HSS §177.07(4)(c). Also: "Mobile home
parks which before the effective date of this chapter either
complied with existing codes or were in existence prior to 1962
shall be allowed to operate without being in compliance with
subs. (1), (2) and (3) [ten foot spacing requirement and 1.5 stall
per unit parking requirement]." See HSS §177.07(4).
2 "Mobile home parks which before February 1, 1986, either
complied with existing codes or were in existence prior to 1962
shall be allowed to operate without being in compliance with
subs. (1), (2) and (3) [i.e., ten foot spacing and 1.5 parking
stall per unit]." See §46.64(4)(a).
3 The Town apparently has the power to regulate mobile home
parks independent of county zoning under Wis. Stat. §66.058(2).
4 For example, HSS §177.07(1)(b) provides: "The basic unit
shall be so located on a site that there is at least a 10 foot side
yard clearance from other basic units." At the same time, the term
"basic unit" is defined to mean "a mobile home without hitch,
awnings, cabanas, storage unit, carport, garage, windbreak, non -
winterized porch or similar appurtenant structures." See HSS
§177.03(3). The county health ordinance at §46.64(1)(b) is
essentially the same.
3
