has submitted a plan showing the existing location of all mobile
homes in the park, together with an overlay which identifies the
61 units to be relocated and the extent of their relocation.
On 1/17/97 the Town and the park owner were advised by
Mr. David D. Lorenz, Dane County Zoning Inspector, that a Zoning
Permit is required to relocate any existing mobile home. Your
applicant agrees with this interpretation as a necessary and proper
enforcement mechanism. However, the Zoning Inspector also
determined that any relocation or replacement of existing mobile
homes must comply with the 30 ft. spacing requirement unless the
owner was granted a variance. Your applicant respectfully
disagrees and has filed this appeal of his determination.
In a conference with staff, Zoning Inspector Patrick D.
Anderson also advised the property owner that he must comply with,
or obtain a variance from, the "off-street" parking requirement
before any mobile homes are relocated within the park. The zoning
code adopted in 1976 requires two "off-street" parking stalls for
each mobile home. HSS Chapter 177 requires parking facilities at
the rate of 1.5 stalls per mobile home,5 which may be either on or
off the park's private streets. The county health code has the
same requirement as the state code,6 and both the state and county
health codes "grandfather" mobile home parks in existence prior to
1962.7
5 See HSS §177.07 (2) .
6 See §46.64 (2) .
See footnotes 1 and 2, supra.
4
