Associates <br /> 2782 International Lane - Suite #201 <br /> Madison, WI 53704 <br /> RE: Setback and yard requirements relocatable school room structures. <br /> Ref: Parcel #28-09-235 - Section 9, Town of Springfield. <br /> Dear Mr. Post: <br /> The Dane County Zoning Ordinance does not provide for specific yard re- <br /> quirements for schools, churches, etc. located in the A-1 Ex. Agriculture <br /> District. Therefore, on an interpretive basis in comparison with similar <br /> uses, traffic generation, etc. , the minimum side and rear yard setbacks <br /> would be the same as required in the B-1 Local Business District. The <br /> requirements are as follows: <br /> 1) . Side and rear yards: Minimum 10 feet. <br /> 2) . Town road setback: Minimum 63' centerline or 30' right-of-way, <br /> whichever is greater. <br /> 3) . State or Federal Highway: 100' centerline or 42 ' right-of-way, <br /> whichever is greater. <br /> One additional factor, the adoption of Exclusive Ag Zoning by the Town <br /> of Springfield in April 1979 caused the school to become nonconforming <br /> because of the requirement that schools must have a conditional use <br /> permit (C.U.P. ). Review of our records discloses that a Conditional <br /> Use Permit has not been issued for this school. Obtaining the require <br /> Conditional Use Permit will be a necessity before we could issue zoning <br /> permits for the proposed structures. <br /> Information pertinent to Conditional Use Permit application has been <br /> enclosed.
