ARTICLE VI . DURATION, MODIFICATION AND REPEAL. <br /> A. DURATION OF DECLARATIONS . These Declarations shall continue <br /> and remain in full force and effect at all times with <br /> respect to all property, and each party thereof, now or <br /> hereafter made subject thereto (subject, however, to the <br /> right to amendment and repeal as provided for herein) until <br /> January 1 , 2008 . However , unless within one (1) year prior <br /> to January 1 , 2008 , there shall be recorded an instrument <br /> directing the termination of these Declarations signed by <br /> owners of not less than two-thirds of the Parcel, then <br /> subject to these Declarations , based on the number of square <br /> feet as in effect immediately prior to the expiration date, <br /> shall be continued automatically without any further notice <br /> for an additional period of ten (10) years and thereafter <br /> for successive periods of ten (10) years unless within one <br /> (1) year prior to the expiration of any such period, the <br /> Declarations are terminated as set forth above in this <br /> paragraph. <br /> B. TERMINATION AND MODIFICATION. These Declarations , or any <br /> provision thereof, or any covenant, condition or restriction <br /> contained herein, may be terminated, extended, modified or <br /> amended, as to the whole of said property or any portion <br /> thereof, with the written consent of the owners of <br /> seventy-five percent (75%) of the property subject to these <br /> Declarations , based on the number of square feet owned as <br /> compared to the total number of square feet subject to these <br /> Declarations; provided, however, no such termination, <br /> -7- <br />
