i <br /> extension, modification or amendment shall be effective <br /> without the written approval of the Review Board except for <br /> a termination pursuant to Section VI (A) above. No such <br /> termination, extension, modification or amendment shall be <br /> effective until a proper instrument in writing has been <br /> executed and acknowledged and recorded in Dane County. <br /> ARTICLE VII . ENFORCEMENT. <br /> If any person shall violate or attempt to violate any of <br /> these covenants , the Town of Westport or any person or persons <br /> owning any lot or lots included in the Parcel shall have standing <br /> to bring proceedings at law or equity against the person or <br /> persons violating or attempting to violate these covenants. In <br /> any action or proceeding to enforce or interpret these <br /> Declarations and Covenants the court, in its discretion, may <br /> allow the prevailing party a reasonable attorney' s fee in <br /> addition to costs. <br /> ARTICLE VIII . EFFECT OF INVALIDATION . <br /> In the event a court determines that a provision of these <br /> Declarations and Covenants is invalid or unenforceable; <br /> (a) The provisions on road access (Article V) and the restricted <br /> uses listed on Exhibit 2 shall be considered separable and <br /> independent from each other and all other provisions of <br /> these Declarations and Covenants and those provisions shall <br /> not be affected by the invalidity of any other part and the <br /> invalidity of either such provision shall not affect the <br /> validity of any other part. <br /> -8- <br />
