EXHIBIT D <br /> DECLARATION OF COVENANTS <br /> THESE DECLARATIONS are made on this 5 day of <br /> , 1987, by co. (herein- <br /> afte referred to as "Declarant") , as owner of the real estate <br /> described on Exhibit D-1 attached hereto and made a part <br /> hereof (said real estate hereinafter referred to as the <br /> "Parcel") and cis ��� �-- I .-was the proposed purchaser <br /> of the Parcel (her nafter referred t6 as "Purchaser") . <br /> ARTICLE I. INTENTION, CONCEPT AND INTERPRETATION <br /> The Declarant intends that the Parcel be developed <br /> for commercial purposes as a commercial park which will <br /> provide employment opportunities for the residents of the <br /> Town of Westport and surrounding areas. This Declaration is <br /> intended to provide for maintaining and controlling develop- <br /> ment upon the Parcel with a park-like character with buildings <br /> and landscaping to enhance the appearance of the entire Parcel <br /> and protect property owners within the development and adjoin- <br /> ing property against unattractive buildings and undesirable <br /> use of building sites. It is the desire of the Declarant to <br /> preserve this concept through the mutual cooperation of all <br /> users of the Parcel by the enforcement of these Declarations. <br /> Approval of building design, landscaping plans and <br /> plans and specifications as described herein in compliance <br /> with these Declarations does not in any way relieve the <br /> Declarant, subsequent owners or users of the Parcel from <br /> obtaining all approvals and permits routinely required by <br /> governmental authorities. It is intended that the Parcel <br /> may be developed and used for all uses allowed by the C-1 <br /> zoning as in existence on this date under the Dane County <br /> Zoning Ordinance except as shown on Exhibit D-2 attached <br /> hereto and made a part hereof. The concepts and intentions <br /> mentioned in this Article shall prevail in the interpreta- <br /> tion and enforcement of these Declarations whether the Parcel <br /> has one building site or is subsequently divided into more <br /> than one building site. <br /> ARTICLE II. PROPERTY SUBJECT TO DECLARATIONS <br /> Declarant herein declares that the Parcel shall <br /> become subject to the Declarations set forth herein so as to <br /> enhance and protect the value, desirability and attractive- <br /> ness of the Parcel and the adjoining properties in which the <br /> Declarant has retained an interest and for the subsequent <br /> interest therein of the Declarant's successors and assigns, <br /> and to enhance and protect the value, desirability and <br /> attractiveness of the Town of Westport in general . These <br /> Declarations shall run with the Parcel and all parts thereof <br />
