EXHIBIT D DECLARATION OF COVENANTS THESE DECLARATIONS are made on this 5 day of , 1987, by co. (herein- afte referred to as "Declarant") , as owner of the real estate described on Exhibit D-1 attached hereto and made a part hereof (said real estate hereinafter referred to as the "Parcel") and cis �� -- I .-was the proposed purchaser of the Parcel (her nafter referred t6 as "Purchaser") . ARTICLE I. INTENTION, CONCEPT AND INTERPRETATION The Declarant intends that the Parcel be developed for commercial purposes as a commercial park which will provide employment opportunities for the residents of the Town of Westport and surrounding areas. This Declaration is intended to provide for maintaining and controlling develop- ment upon the Parcel with a park-like character with buildings and landscaping to enhance the appearance of the entire Parcel and protect property owners within the development and adjoin- ing property against unattractive buildings and undesirable use of building sites. It is the desire of the Declarant to preserve this concept through the mutual cooperation of all users of the Parcel by the enforcement of these Declarations. Approval of building design, landscaping plans and plans and specifications as described herein in compliance with these Declarations does not in any way relieve the Declarant, subsequent owners or users of the Parcel from obtaining all approvals and permits routinely required by governmental authorities. It is intended that the Parcel may be developed and used for all uses allowed by the C-1 zoning as in existence on this date under the Dane County Zoning Ordinance except as shown on Exhibit D-2 attached hereto and made a part hereof. The concepts and intentions mentioned in this Article shall prevail in the interpreta- tion and enforcement of these Declarations whether the Parcel has one building site or is subsequently divided into more than one building site. ARTICLE II. PROPERTY SUBJECT TO DECLARATIONS Declarant herein declares that the Parcel shall become subject to the Declarations set forth herein so as to enhance and protect the value, desirability and attractive- ness of the Parcel and the adjoining properties in which the Declarant has retained an interest and for the subsequent interest therein of the Declarant's successors and assigns, and to enhance and protect the value, desirability and attractiveness of the Town of Westport in general . These Declarations shall run with the Parcel and all parts thereof
