for all purposes and shall be binding upon and inure to the <br /> benefit of the Declarant, the Purchaser, and all owners, <br /> lessees, occupants and successors in interest as set forth <br /> herein, including, but not limited to, the Town of Westport <br /> which, as an adjoining owner, has an interest in the develop- <br /> ment of the Parcel, which interest is hereby recognized by <br /> the Declarant and the Purchaser. <br /> ARTICLE III. REVIEW BOARD <br /> The architectural and design review referred to in <br /> these Declarations will be by the "Review Board" which will <br /> consist of the members of the Town Board of the Town of <br /> Westport. The Town Board may appoint a committee consisting <br /> of the members of the Town of Westport Planning Commission <br /> to advise the Town Board. A simple majority of the members <br /> of the Review Board shall constitute a quorum, and all action <br /> of the Review Board shall be taken by a majority vote. <br /> The Declarant has not made himself a member of the <br /> Review Board because he is confident that the Town Board or <br /> its appointees will adequately perform the duties imposed <br /> upon the Review Board and, therefore, Declarant, by virtue <br /> of this document, assigns to the Town of Westport all rights <br /> that the Declarant could retain by law to impose and enforce <br /> the covenants, relating to the use of the Parcel, and Purchaser, <br /> by executing these Declarations, acknowledges all rights <br /> herein given to the Town of Westport and the Review Board <br /> and agrees to be bound by these Declarations for themselves, <br /> their successors and assigns. <br /> ARTICLE IV. REGULATION OF IMPROVEMENTS <br /> A. APPROVAL REQUIRED. No improvement shall be erected, <br /> placed or altered on any land subject to these <br /> Declarations until the architectural design of the <br /> proposed improvement together with the landscaping <br /> plan has been approved in writing by the Review <br /> Board based on a preliminary rendering of such <br /> proposed improvement and a general landscape plan <br /> including proposed exterior elevations, finish <br /> contours, driveways, exterior lighting, loading <br /> and parking areas, and existing trees or trees to <br /> be planted and until the final plans and specifica- <br /> tions for the proposed improvement have been <br /> approved in writing by the Review Board.* Said <br /> preliminary rendering, general landscape plan and <br /> * See Addendum - Page 8 <br /> -2- <br />
