final plans and specifications are to be signed by <br /> the owner of the subject land. <br /> B. BASIS FOR APPROVAL. Approval of the architectural <br /> design of the proposed 'improvement and the landscap- <br /> ing plan shall be based on adequacy of site dimen- <br /> sions, aesthetically pleasing external design and <br /> relation of topography, grade and finish ground <br /> elevation of the site being improved to that of <br /> neighboring sites. Approval of the final plans <br /> and specifications for the proposed improvement <br /> shall be based solely on whether said final plans <br /> and specifications are consistent with said pre- <br /> liminary plans. The Review Board shall not withhold <br /> its approval of any architectural design of a <br /> proposed improvement, any landscaping plan, or any <br /> final plans and specifications which substantially <br /> comply with the concept and intent of Article I <br /> and this Subparagraph IVB. <br /> C. RESULT OF INACTION. If the Review Board fails <br /> either to approve or disapprove documents submitted <br /> to it pursuant to these declarations within forty- <br /> five (45) days after the same have been submitted <br /> to it, it shall be conclusively presumed that the <br /> Review Board had approved the same; provided, <br /> however, that if within said forty-five (45) day <br /> period, the Review Board gives written notice of <br /> the fact that an additional thirty (30) days is <br /> required for the consideration of such document or <br /> documents, it shall be conclusively presumed that <br /> the Review Board has approved such document or <br /> documents if it fails either to approve or disapprove <br /> the same within such additional time period. In <br /> the event the Review Board disapproves any document <br /> submitted to it pursuant to these declarations, it <br /> shall notify the owner submitting same of such <br /> disapproval giving the specific reasons for such <br /> disapproval in writing. <br /> D. COMPLETION CERTIFICATE. Within thirty (30) days <br /> after a written request by an owner of land within <br /> the Parcel is delivered to the Review Board, the <br /> Review Board shall inspect the premises. If the <br /> Review Board agrees that the improvement has been <br /> constructed substantially in accordance with the <br /> preliminary rendering and final plans and specifica- <br /> tions approved by the Review Board and/or the <br /> landscaping has been completed substantially in <br /> -3- <br />
