accordance with the general landscape plan approved <br /> by the Review Board, the Review Board shall furnish <br /> to such owner a certificate in recordable form <br /> certifying that said improvement was constructed <br /> and said landscaping was done substantially in <br /> accordance with the Declarations. In the event <br /> the Review Board does not agree that the improve- <br /> ment has been so constructed and/or the landscaping <br /> has been so completed, the Review Board shall <br /> provide the owner with a certificate which will <br /> identify the non-complying improvements or work <br /> and set forth with particularity the cause or causes <br /> for such non-compliance. <br /> ARTICLE V. ROAD ACCESS <br /> Because of the current traffic situation applicable <br /> to County Trunk Highway M, there shall be no access from the <br /> Parcel or any part thereof directly onto County Trunk Highway <br /> M except as may be approved specifically by the Review Board <br /> in writing. It is anticipated that at some time in the <br /> future County Trunk Highway M will be improved so as to <br /> increase its traffic-bearing capabilities. This provision <br /> relating to access to County Trunk Highway M shall continue <br /> until such time as such improvements by Dane County are <br /> accomplished. Until such improvements are accomplished on <br /> County Trunk M, it is the intent of these Declarations to <br /> discourage the use of the Parcel by an individual retail <br /> store with in excess of 25, 000 square feet of retail space, <br /> but nothing in these Declarations shall be construed to <br /> discourage other commercial or retail uses of the Parcel. <br /> It is also presently anticipated that access to the Parcel <br /> will initially be from Woodland Drive at a point north of <br /> the Conservancy District on the Parcel and that access from <br /> Mary Lake Road will be allowed upon the improvement of Mary <br /> Lake Road or on April 15, 1990, whichever occurs first. <br /> The provisions in this paragraph concerning access to Mary <br /> Lake Road shall be binding on the Review Board, but shall <br /> not be considered as a waiver by the Town of Westport of <br /> any review or approval of such access authorized or <br /> required by law. <br /> ARTICLE VI . DURATION, MODIFICATION AND REPEAL <br /> A. DURATION OF DECLARATIONS.
