However, unless within one (1) year prior <br /> to January 1, 2008, there shall be recorded an <br /> instrument directing the termination of these <br /> Declarations signed by owners of not less than <br /> two-thirds of the Parcel, then subject to these <br /> Declarations, based on the number of square feet <br /> as in effect immediately prior to the expiration <br /> date, shall be continued automatically without any <br /> further notice for an additional period of ten <br /> (10) years and thereafter for successive periods <br /> of ten (10) years unless within one (1) year prior <br /> to the expiration of any such period, the Declara- <br /> tions are terminated as set forth above in this <br /> paragraph. <br /> B. TERMINATION AND MODIFICATION. These Declarations, <br /> or any provision thereof, or any covenant, condition <br /> or restriction contained herein, may be terminated, <br /> extended, modified or amended, as to the whole of <br /> said property or any portion thereof, with the <br /> written consent of the owners of seventy-five <br /> percent (75%) of the property subject to these <br /> Declarations, based on the number of square feet <br /> owned as compared to the total number of square <br /> feet subject to these Declarations; provided, <br /> however, no such termination, extension, modifica- <br /> tion or amendment shall be effective without the <br /> written approval of the Review Board except for a <br /> termination pursuant to Section VI (A) above. No <br /> such termination, extension, modification or amend- <br /> ment shall be effective until a proper instrument <br /> in writing has been executed and acknowledged and <br /> recorded in Dane County. <br /> ARTICLE VII. ENFORCEMENT <br /> If any person shall violate or attempt to violate <br /> any of these covenants, the Town of Westport or any person <br /> or persons owning any lot or lots included in the Parcel <br /> shall have standing to bring proceedings at law or equity <br /> against the person or persons violating or attempting to <br /> violate these covenants. In any action or proceeding to <br /> enforce or interpret these Declarations and Covenants the <br /> court, in its discretion, may allow the prevailing party a <br /> reasonable attorney's fee in addition to costs. <br /> -5- <br />
