Anderson <br /> Chairman, Agriculture, Environment <br /> and Land Records Committee <br /> City-County Building <br /> Madison, WI 53709 <br /> HAND DELIVERED <br /> RE: Zoning Petition No. 4014 <br /> Menard, Inc./Vitense <br /> Town of Middleton <br /> Dear Lyman: <br /> The above zoning petition will be considered by the Agriculture, Environment <br /> and Land Records Committee on September 29 and the Dane County Board on <br /> October 1. As the attorney for Menard, Inc. , I will try to succinctly state <br /> our case. <br /> To be brief will be difficult but I will certainly try. It is difficult <br /> because there have been many, many issues raised, some of which are <br /> irrelevant. To use a baseball analogy, I would urge all of you to "keep <br /> your eye on the ball". The ball, in this case, is the question: "Is what <br /> Menard is proposing for this particular site an appropriate land use?". <br /> Obviously, we think the answer is "yes". <br /> 1. What is the relevance of the Dane County Regional Planning Commission's <br /> action supporting the Town of Middleton's request to alter the Central <br /> Urban Service Area's boundary? <br /> On September 24, 1987 the Dane County Regional Planning Commission voted <br /> 6-3 to extend the Central Urban Service Area to allow for Menard's to <br /> install a public sewer and water system as part of its proposed Home <br /> Improvement Center. The Town made this request because one of the <br /> principal objections to this project raised during your April 2, 1987 <br /> meeting when the Board was evenly divided, was the argument that this <br /> was an urban facility that was being proposed outside of the Urban <br /> Service boundary. <br /> As Supervisor Leidner stated at that RPC meeting, "If we act tonight to <br /> expand the Urban Service Area, there is no question the rezoning will <br /> pass. Enough votes will be changed that Menard's is a fait accompli. <br /> You're giving the County Board something they may as well not vote on." <br /> I wouldn't go quite that far, but I do feel that the Commission's <br /> decision which was made after enormous public input and staff comments <br /> from both sides is very relevant to your decision. <br />
