• <br /> September 28, 1987 <br /> Page Two <br /> It is relevant because it makes it a virtual certainty that this parcel <br /> will be developed commercially in the near future. The Commission's <br /> decision to use engineering standards such as the County M right of way <br /> as the basis for the boundary rather than somewhat arbitrarily dividing <br /> the parcel in two between what is and what is not in the Urban Service <br /> Area, greatly increases the value of this land. It also represents an <br /> important policy decision by the Commission that the existing businesses <br /> and residents in the immediate area need public water and sewer. I <br /> think it was important that the Dane County Environmental Health <br /> Division stated in a letter to the Commission: <br /> This office is concerned about the long term prospects of <br /> this area in regard to private waste disposal. There is a <br /> strong likelihood that the existing systems may be discharg- <br /> ing unpurified sewage to subsurface waters, which has sub- <br /> stantial public health implications. In addition, all such <br /> systems will eventually need replacement. Many of the <br /> systems in this area are at or beyond the expected operational <br /> life span. <br /> As part of this projet, Menard's intends to construct a public sewer and <br /> water system that will address not only their needs but the environment- <br /> al health concerns raised by your Sanitarian. The estimated cost of <br /> this system is nearly $600,000--a cost that the Town of Middleton may <br /> not be able to bear on their own, if they had to. <br /> Finally, the RPC's action is a clear message from your chief planning <br /> agency that this is good land use policy for Dane County. In this <br /> action, the Commission adopted one of the alternative staff recommenda- <br /> tions which was to approve the boundary change for the existing busi- <br /> nesses and residents and for the portion of the Menard/Vitense parcel <br /> which is the subject of your rezoning decision. As for the remaining <br /> 43.7 acres, the RPC deferred action on the Town's request to expand the <br /> Urban Service Area to include this entire parcel until the Town comes <br /> forth with an update of its land use plan for the entire parcel. Thus, <br /> the RPC's decision to expand the Urban Service Area as far as they did <br /> was a compromise that accepted the Town's position that Menard's and the <br /> existing users needed public water and sewer. <br /> 2. What action did the Town of Middleton take regarding this proposal? <br /> On August 17, 1987, after countless public meetings before the Town of <br /> Middleton Board and individual meetings with representatives of <br /> adjoining property owners, the Town of Middleton unanimously approved <br /> the above rezoning request subject to the following conditions: <br />
