DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition No. 7596/1576 Public Hearing Date: 6/22/99 <br /> Applicant/Agent: Gary Grundahl Work Meeting Date: 7/13/99 <br /> I. BACKGROUND <br /> A. Request <br /> Gary Grundahl is requesting to rezone 7.9 acres from the A-1 Agriculture (Exclusive) District to the A-2 <br /> (4) Agriculture District with a Conditional Use Permit (CUP) to allow for: (1) a horse boarding stable, a <br /> riding stable, and horse shows and similar events; (2) unlimited livestock on 3-16 acres; (3) sale of <br /> agricultural and dairy products not produced on the premises and the incidental sale of pop and candy; (4) <br /> retail sales of bridles, saddles, grooming supplies and related items limited to a maximum area of 150 s.f.; <br /> and (5) training of horses at a horse boarding facility. An illustration of the subject property area is <br /> included here as Attachment A. <br /> B. History/Past Actions <br /> This petition was presented at the June 22, 1999 Zoning and Natural Resources Committee's Public <br /> Hearing. It was postponed until the July 13, 1999 Work Meeting to allow time for the applicant to <br /> prepare and submit a more detailed site plan. The submitted site plan is included here as Attachment B. <br /> There was a similar petition on the same property in 1995: Rezone Petition No. 6300 and CUP No. 1248 <br /> by Thomas Tubbs,et al.to change the zoning from the A-1 Agriculture(Exclusive)District to the A-2 (4) <br /> Agriculture District with a CUP to allow for a horse boarding stable, unlimited livestock, and a limited <br /> family business (i.e. electrical contracting) on five (5) acres. As noted in the Zoning Staff Report, this <br /> rezone/CUP area was located about 377 ft. east of the current subject property's eastern boundary line. <br /> This previous petition was approved in July of 1995, but the required CSM was not filed, and the rezone <br /> became null and void. <br /> The Town Board of the Town of York approved this current petition unanimously on June 14, 1999, with <br /> the following conditions: (1) acreage to be 8.5 acres with the right-of-way; (2) zoning from A-1 <br /> Agriculture (Exclusive) to A-2 (8); and (3) balance of acreage to remain with farm due to unlimited <br /> livestock to allow for manure disposal. The Town also granted the following CUP uses, as derived from <br /> the Dane County Code of Ordinances s. 10.126 (3), Conditional Uses Permitted in the A-2 District: <br /> (o) kennels, horse boarding stables, riding stables, hay and sleigh rides, horse shows and <br /> similar events; <br /> (p) unlimited livestock on 3 to 16 acres; <br /> (q) sale of agricultural and dairy products not produced on the premises and incidental sale <br /> of pop and candy; <br /> (s) retail sales of bridles, saddles, grooming supplies and related items at a horse boarding or <br /> riding stable facility (said use shall be limited to a maximum of 150 sq. ft. of floor <br /> space); and <br /> (u) training of dogs at a dog kennel or training of horses at a horse boarding facility. <br /> Dane County Planning and Development Department Page 1 of 5 <br /> Staff Report for Petition No. 7596/1576 <br />
