C. Site/Locational Information <br /> The 7.9-acre subject property is located in part of the SE '/4 of the SE '/4 and in part of the SW '/4 of the SE <br /> '/4 of Section 33 in the Town of York, approximately one mile north of the Village of Marshall. The <br /> applicant owns the entire 160 acres that comprise the SE 1/4 of Section 33. There appears to be an existing <br /> farmstead owned by Agnes Conklin within a 775 feet radius of the southeast corner of the proposed CUP <br /> area. The remaining land surrounding the property is held in agricultural and other open space uses and <br /> is zoned A-1 Agriculture(Exclusive). <br /> D. Other federal,state or county approvals required <br /> The standard County approvals will apply. In addition to the rezone and CUP, a zoning permit will be <br /> required for the construction of the 46,400 s.f. stable and indoor riding arena. An erosion control permit <br /> will also be required for the stable and indoor riding arena,as per Chapter 14 of the Dane County Code of <br /> Ordinances(DCCO). <br /> IL ANALYSIS <br /> A. Compliance with County Ordinances <br /> Chapter 10, Zoning, and Chapter 14, Soil Erosion Control & Manure Storage, and Chapter 75, Land <br /> Division and Subdivision Regulations, will all apply. In regard to Chapter 10, the petition appears to <br /> comply with the proposed district's uses and standards. The proposed parking areas will need to comply <br /> with s. 10.18 Off-Street Parking and Loading of the DCCO. This will be checked at the time the <br /> applicant applies for the zoning permit that will be needed to construct the proposed stable and indoor <br /> riding arena. <br /> In the granting of a CUP, there are six standards against which the project needs to be reviewed as per s. <br /> 10.255(2)(h)of the Dane County Code of Ordinances: <br /> 1. That the establishment, maintenance, or operation of the conditional use will not be <br /> detrimental to or endanger the public health, safety, comfort or general welfare. <br /> 2. That uses, values, and enjoyment of other properties in the neighborhood for purposes <br /> already permitted shall be in no foreseeable manner substantially impaired or diminished <br /> by establishment, maintenance, or operation of the conditional use. <br /> 3. That the establishment of the conditional use will not impede normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> 4. That adequate utilities, access roads, drainage, and other necessary site improvements <br /> have been made or are being made. <br /> 5. That adequate measures have been or will be taken to provide ingress and egress so <br /> designed as to minimize traffic congestion in the public streets. <br /> 6.
