III. CONCLUSIONS A. Summary of main issues/findings Jim Murphy is applying for a conditional use permit (CUP) on his 0.76 acre parcel to: (1) bring into conformance the existing tavern use; (2) bring into conformance existing, seasonal outdoor entertainment (e.g. the annual Riley Fest and the seasonal blue-grass music performances); and (3)to allow for outdoor games such as horseshoes, volleyball, or similar activities to be lighted and operate at night. The Riley Tavern has been in operation at this site for over 50 years, but has never had a CUP for either the tavern use or the annual Riley Fest that occurs on the third Saturday of every August. This petition is a good faith effort on the part of the applicant to bring the current operation into compliance. Furthermore, the applicant is seeking to expand the activities on the site to include a lighted, outdoor volleyball court, a 39- stall concrete parking lot, and a 3,575 s.f. garage that will include an 845 s.f. area to be used as an expansion of the existing tavern use that "would permit food service and sales of individual beverages during those times of the year when outdoor entertainment activities are provided (e.g. Riley Fest and the blue-grass music performances)." The three conditional uses for which the applicant is petitioning as per s. 10.13(2) of the DCCO are: (c) Motels, hotels, taverns,funeral homes and drive-in establishments. This conditional use is needed to bring the existing grandfathered tavern use into conformance. (1) Outdoor amusement parks or other entertainment activity that is open to the public on either a permanent or temporary basis. This conditional use is needed to allow for and bring into conformance the annual Riley Fest and other seasonal activities such as the summer blue-grass music performances. (o) Games such as horseshoes,volleyball or similar activities lighted to operate at night. This conditional use is needed to allow for the proposed expansion of the on-site activities,particularly the lighted volleyball court. B. Any recommended conditions of approval Until the Town of Springdale has completed its action on this petition, it would be premature to propose any potential conditions of approval. Conditions will be provided following town action, and should be completed before the ZNR's next Work Meeting to be held on Tuesday,August 10, 1999.
