FROM : PHONE NO. : Jul. 21 1999 04:40PM P3 <br /> in a valid premises description for outdoor consumption. <br /> (h) SPECIAL PERMITS FOR OUTDOOR CONSUMPTION may be granted by the Town Board <br /> only when the applicant has demonstrated to the satisfaction of the Town Board <br /> the successful mitigation of potential negative impacts of noise, parking, <br /> lights, trespassing, public safety, etc. on surrounding properties. <br /> Each applicant for a special permit for outdoor consumption shall accurately <br /> describe the area of the licensed premises, not enclosed within the <br /> building(s) where outdoor consumption of beer/liquor shall be permitted, on a <br /> site plan which shall become a part of the ligg2r license. <br /> Each applicant for a special permit for outdoor consumption shall indicate the <br /> nature of fencing or other measures intended to provide control over the <br /> operation of the outdoor consumption area. <br /> Every area for outdoor consumption shall be clearly designated for the safety <br /> of its patrons and for compliance with liquor serving regulations. <br /> No amplified sound or music is permitted outside the enclosed (building) <br /> premises. Amplified sound or music is not permitted in the outdoor consumption <br /> area except where permitted by the Town Board. <br /> Lighting for the outdoor entertainments areas and the outdoor consumption, area <br /> shall be of the type designed to focus light down and minimize impacts on the <br /> neighboring property owners. <br /> Parking areas shall be designated to allow safe passage of all types of <br /> vehicles on all roads. <br /> There shall be a licensed operator with the outdoor consumption area at all <br /> times this specific area is in operation. <br /> ADJOURN: MOTION by Burns/Hacker to adjourn.
