Whether agriculture practices are <br /> occurring adjacent to the waterway is irrelevant to Wisconsin and federal Waterway regulations. <br /> I reviewed the information you provided and have determined that the waterway North of Dunlop Hollow Road is not <br /> navigable for Chapter 30 permit requirement purposes.This determination was made solely on the basis that is does not <br /> meet the definition of a navigable waterway. It does however meet the definition of a watercourse and would be subject to <br /> Chapter 31 permit requirements in the future. (aka any"impounding" of the waterway would be regulated) <br /> On a side note, a thousand "minuscule" events can lead to devastation when looked at cumulatively, which is how the DNR <br /> and Army corps of engineers reviews waterway and wetland impacts. Any future proposed activities that may impact waters <br /> of the state should be submitted to the Department for review.
