The project is a barn-like storage structure which will be used for agricultural purposes. <br /> Please refer to the powerpoint file "barnpackage_shoreland"I sent in a previous email for the project plan. <br /> We would like a reassessment of the navigability status of#5033899 for the following reasons: <br /> 1) this is a constructed, not natural, waterway. The ditching was done sometime between 1937 and 1992 <br /> according to air photos, which I can supply if needed. Any perceived bed and bank is due to previous <br /> construction and not natural water action. <br /> 2) this waterway, although ditch-like, rarely has water in it and functions as an agricultural grassy <br /> waterway rather than a stream. Our observations are that it is only conducting water during spring <br /> snowmelt and when there are intense rain events, such as over 2" in one hour. <br /> 3) this waterway is entirely within an actively farmed agricultural field, and soil is annually disturbed right <br /> up to the waterway in normal agricultural practices. Soil disturbance due to this barn project is minuscule <br /> in comparison. <br /> We are petitioning you either declare WBIC#5033899 non-navigable or grant us an agricultural exemption <br /> for this project. Please contact me as soon as possible regarding this issue.
