<br /> the South Line of the Southwest Quarter;Thence W 26°-03'-
<br /> 35"E 2985.28 feet to the POINT OF BEGINNING;Thence N
<br /> 89°-19'-32"W 235.81 feet,Thence N 1°-25'-39"E 277.40 feet,
<br /> Thence N 73°-02'-13"E 192.50 feet,Thence N 64°-30'-00"E Return to:

<br /> WHEREAS,the Owner has recorded a certified survey map to
<br /> divide the Property into four lots,as recorded in
<br /> SueSEQUFAIT Doc O.a 1.1T .
<br /> THIS SEWER EASEMENT AGREEMENT,made this ay January, by of Janu ,2008,b and between Waubesa
<br /> Willow LLC,hereinafter referred to as"Grantor,"and Waubesa Willow LLC,hereinafter referred to as"Grantee."
<br /> RECITALS:
<br /> A. Grantor 1 is the owner of certain real property located in Dane County, Wisconsin, as described on the
<br /> attached Exhibit A and referred to on the exhibit and in this Agreement as Parcel A. B. Grantor 2 is the owner of
<br /> certain real property located in Dane County,Wisconsin, as described on the attached Exhibit A and referred to on
<br /> the exhibit and in this Agreement as Parcel B.Grantor 1 and Grantor 2 are collectively referred to as"Grantors"and
<br /> individually as "Grantor." Grantee is the owner of certain real property located in Dane County, Wisconsin, as
<br /> described on the attached Exhibit A and referred to on the exhibit and in this Agreement as Parcel C.
<br /> B. Grantee has requested that the Grantors grant and convey to the Grantee a temporary construction easement
<br /> and a permanent easement over, upon, across, under and through a portion of the property of the Grantors for
<br /> purposes of constructing, operating, maintaining, repairing, inspecting and reconstructing sewer lines and
<br /> accessories and the Grantors have agreed to do so.
<br /> For good and valuable consideration, the receipt and sufficiency of which are acknowledged, the parties
<br /> agree as follows:
<br /> 1.Grantors hereby do give,grant,and convey unto the Grantee,its successors and assigns:
<br /> PERMANENT EASEMENT: A nonexclusive permanent easement for purposes of operating,
<br /> maintaining, repairing, inspecting and reconstructing sanitary sewer lines, together with such pipes, manholes,
<br /> fittings, fixtures and other accessories as from time to time may be required, and for purposes of inspecting and
<br /> performing appropriate tests within said permanent easement,and together with the full right of reasonable access to
<br /> and egress from said permanent easement over and upon the above-referenced Property or other property of Grantor,
<br /> said permanent easement being more particularly described on the attached Exhibit A.
<br /> TEMPORARY CONSTRUCTION EASEMENT: A temporary construction easement for the purposes
<br /> of excavation, digging ditches, storing dirt, supplies and materials, moving and using equipment and generally
