carrying out the completion of the construction and installation of said sanitary sewer lines and accessories, and for
<br /> the purposes of inspecting and performing appropriate tests within said temporary construction easement, together
<br /> with the full right of reasonable access to and egress from said temporary construction easement over and upon the
<br /> above-referenced Property or other property of Grantor, for all purposes in connection with said construction and
<br /> installation, it being understood that this right of use as set out in this paragraph shall terminate upon the final
<br /> completion of the entire project, said temporary construction easement being more particularly described on the
<br /> attached Exhibit A.
<br /> 2.The Grantors shall at all times,other than while the sewer lines are under actual construction,have the right to use
<br /> said permanent easement and said temporary construction easement, in any manner consistent with common uses
<br /> associated with residential premises;provided such use shall not unreasonably interfere with or be inconsistent with
<br /> the use thereof by Grantee as provided herein. The erection of a non-portable shed, building or other structure
<br /> within the permanent easement by the Grantor shall not be allowed. The Grantor may construct a driveway over a
<br /> portion of the easement and may landscape portions of the easement. The Grantee, in future repairs or maintenance
<br /> of the sewer lines and accessories, shall be responsible for repairing any portion of the driveway or landscaping
<br /> disturbed by such work. The Grantor may have a sewer service line within the easement property that leads from
<br /> the Grantor's residence to the main sewer line and may perform all activities associated with such sewer line.
<br /> 3.The Grantee shall not materially interfere with the use by and operation and activities of Grantor on its property,
<br /> and Grantee shall use such routes and follow such procedures on Grantor's property as result in the least damage and
<br /> inconvenience to Grantor. The Grantee shall have the right to clear the permanent easement and temporary
<br /> construction easement area as necessary to perform the activities that Grantee is permitted to perform hereunder.
<br /> 4. The Grantee shall maintain any improvements constructed or installed thereon by Grantee or associated with
<br /> Grantee's use of the easement property.The operation and maintenance of such improvements and of the easement
<br /> property shall be at Grantee's sole cost and expense.
<br /> 5. That the Grantee agrees to restore the topography of said easement area after installation, inspection,
<br /> reconstruction or any other activities relating to the sewer lines and accessories that disturb the topography of the
<br /> easement property. Grantee's restoration will occur promptly and within a reasonable time following completion of
<br /> the installation of the sewer line, and the topography shall be restored to approximately the same condition that
<br /> existed before installation. Grantee shall be responsible for any damage to Grantor's property or that of third parties
<br /> resulting from any exercise of the rights herein granted, including but not limited to soil erosion, subsidence or
<br /> damage resulting there from. Grantee shall promptly repair and restore to its original condition any of Grantor's
<br /> property, including, but not limited to, driveways, utilities, buildings, landscaping and other structures that may be
<br /> altered,damaged or destroyed in connection with the exercise of the easements or use of the easement area.
<br /> 6.The Grantor hereby authorizes the Grantee to enter upon the Grantor's property and to excavate on the Grantor's
<br /> property outside of the permanent and temporary construction easements described herein for the purpose of
<br /> locating and connecting said service line.
<br /> 7. Grantee shall comply with all applicable laws, ordinances and regulations, including but not limited to all
<br /> applicable regulatory,environmental and safety requirements at Grantee's sole cost and expense. Grantee shall not
<br /> use,deposit or permit the use or deposit of any hazardous material or toxic waste or other harmful substances on the
<br /> easement area or on any other real property of Grantor adjacent to the easement area. The Grantee alone shall pay
<br /> any and all taxes, charges or use fee(s) levied by any governmental agency against Grantee's interest in the
<br /> Easement Area, or against any of Grantor's real property as a result of the Easement herein granted. Grantee shall
<br /> not cause liens of any kind to be placed against the Easement Area or any of Grantor's real property.
<br /> 8.This easements herein are granted on the express condition that Grantor is to be free from all liability by reason of
<br /> injury or death to persons or injury to property from whatever cause arising out of Grantee's, or Grantee's agents',
<br /> officers', employees',.invitees' (including contractors), or licensees', exercise of rights granted pursuant to these
<br /> easements or use of the easement area or of the improvements or personal property of Grantee thereto or thereon,
<br /> including any liability for injury or death to the person or property of Grantee, its contractors, agents, officers,
<br /> members, employees, invitees, or licensees or to any property under the control or custody of Grantee. Grantee
<br /> hereby covenants and agrees to defend and indemnify Grantor, its officers, employees, agents, invitees and guests
