01/26/2007 FRI 09:03 FAX 8349999 HEXAGON TITLE 2012/032 <br /> 1)4)4)262 <br /> (d) To guard and protect against the construction of poorly designed or <br /> proportioned structures or structures built of Improper or unsuitable material; <br /> (e) To encourage and secure the building of attractive, adequately <br /> sized homes that conform to general structural design standards throughout the <br /> Development and that are In compliance with proper site planning relative to the <br /> individual lot constraints; and <br /> (f) To strive towards providing for improvements within the <br /> Development which will protect the individual lot purchaser's Investment. <br /> 3.19 The Developer, after a period of ten (10)years from the date of <br /> recording the final Plater after seventy-five percent(75%) of the lots within the <br /> Property (other than outlots) have been sold, whichever comes first, may elect to <br /> assign all of the Developer's rights to approve all of the items set forth herein to <br /> the Architectural Control Committee. <br /> 3.20 All lots shall be so cultivated or tended as to keep them free from <br /> noxious weeds. <br /> 3.21 Each property owner is responsible to obtain a driveway permit <br /> from the Town of Sun Prairie prior to commencement of construction. Driveway <br /> culverts and driveways shall be installed to the Town of Sun Prairie and Dane <br /> County standards by the Owner of the lot and at the expense of the Owner. <br /> (a) Damage to Prospector Road or any improvements of the Plat by <br /> any lot owner or their contractors, agents or employees shall be repaired at the <br /> expense of said lot owner within 60 days of completion of construction and to <br /> the standards set by the Town of Sun Prairie. <br /> 3.22 No Owner shall re-grade or obstruct any swale or drainage way to <br /> water detention areas, whether protected by easement or not, which is in <br /> existence at the time of development so as to impede the flow of or detain <br /> surface water from other lots through such swale, drainage way or detention <br /> area. No structure, planting or other materials shall be placed or permitted to <br /> remain within these areas. <br /> 3.23 If any lot owner shall violate or attempt to violate any covenant or <br /> restrictions with regard to ditches, swales, drainage easements or detention <br /> are or if any lot owner responsible for specific duties presented herein with <br /> regard to ditches, swales, drainage easement or detention areas, within the <br /> terms set forth, shall fall to perform such duties,the Town of Sun Prairie shall <br /> have standing to bring proceedings at law or equity against the person or <br /> persons violating or attempting to violate such and the Town shall be awarded <br />
