The Town of Sun <br /> Prairie or the Architectural Control Committee shall have the right to levy a <br /> maintenance assessment against the responsible lot owner to defer the expenses <br /> of said remedy. <br /> 3.24 Developer is Installing rain gardens on each lot for the purpose of <br /> water retention. It is the responsibility of each lot owner to maintain the rain <br /> garden and agree to not alter or remove It. No buildings or other Improvements <br /> may be constructed in the rain garden and the grade may not be changed. If <br /> rain gardens are located on more than one lot, each owner shall be responsible <br /> for compliance with this section as to that portion of the rain garden which is <br /> located on that owner's lot. <br /> 3.25 Developer reserves the right to install a sign identifying the <br /> subdivision within the property. Developer also reserves the right to Install a <br /> landscaped berm or decorative features along the north property line of the <br /> Property. The Developer or the Architectural Control Committee shall be <br /> permitted to have access to such signs for maintenance and repair purposes, <br /> until all lots are sold. <br /> 3.26 These Covenants, Restrictions and Conditions may only be <br /> amended in a written document signed by not less than two-thirds of the lot <br /> owners in Drovers Woods First Addition. In addition, any change to the <br /> provisions regarding fences, drainage or rain gardens require the approval of the <br /> Town Board for the Town of Sun Prairie.
