Appeal by Thomas J. and Barbara Lowe for variances from minimum required lot width <br /> at the building setback line and minimum required lot area for an existing substandard platted lot in the <br /> Shoreland District as provided by Sections 11.03(1) and 10.05(4), Dane County Code of Ordinances, to <br /> permit additions to single-family residence as constructed at 7876 Fish Lake Road, being Lot 10, <br /> Gaukel's Fish Lake Subdivision, Section 03, Town of Roxbury. <br /> OWNER: Thomas J. and Barbara Lowe <br /> AGENT: Same <br /> LOCATION: 7876 Fish Lake Road <br /> ZONING DISTRICT: R-3 Residential and Shoreland — Fish Lake <br /> COMMUNICATIONS: Town of Roxbury— 03/13/2008Acknowledgement; 04/23/2008 Email for Robert <br /> Pings, Clerk: "Town of Roxbury has no problem with the variance request from Thomas & Barbara Lowe <br /> as long they have all county permits. They have Town permits." <br /> 04/24/2008 Email from Cami Peterson, Water Regulations and Zoning Specialist, WDNR: "No <br /> comments" <br /> Facts of the Case: <br /> Existing: <br /> • Shoreland lot is 16,604 SF and 69.95 feet at ROW line Fish Lake Road, per current survey. (Original <br /> lot platted in 1957 showed 70.00 feet at ROW.) Lot does not meet minimum width of 100 feet at <br /> building setback line or minimum lot area for unsewered lots of 20,000 SF in Shoreland district. <br /> • Lot includes Lowe's house: 24.4'x20.4' with 10'x12.4' enclosed porch on south side and 6'x12.3' <br /> pump house/shed addition on north side. There formerly was a concrete stoop at the south porch <br /> exit door. Lowe replaced the stoop with a 5'x9' "landing " (deck and steps). The house (built in 1961, <br /> according to Lowe) with all current additions meets minimum side yard, setback from OHWM and <br /> maximum lot coverage requirements. <br /> • House and lot have been affected by high water levels of Fish Lake in recent years. <br /> • Lowe obtained a building permit (not in file) from the Town Building Inspector, according to his <br /> statement, to remove and replace pump house/shed on existing footprint, replace some structural <br /> members of existing porch and add the landing/deck. He did not obtain a Dane County Zoning <br /> Permit <br /> Zoning Notes: <br /> • Similar variances, were granted 07/26/2007, under Appeal 3482, to Leonard Porter, the neighbor to <br /> the north of Lowe, for variances to minimum lot width and area in the Shoreland district, and for <br /> minimum setback from OHWM, allowing removal of a 10'x24' three-season porch, which was <br /> replaced with a four-season room on the same footprint. (A variance to allow a proposed 8'x13.5' <br /> foot deck on the lake side of the new room was abeyed. Porter did not return to the Board with the <br /> requested survey documentation needed for action on the deck; he has steps to a patio instead.) <br /> History <br /> • ZP 27674 for 6'x12' storage addition to SFR issued to Lowe in 1977. <br /> VARIANCES REQUESTED: Purpose: Allow additions/alterations to single-family home, as <br /> constructed. <br /> Variances needed for: <br /> Minimum required lot area: 20,000 SF <br /> Actual Lot Area: 16,604 +- SF <br /> Variance needed: 3,396 +- SF <br /> Minimum required lot width at the building setback line 100 feet <br /> Actual Lot width at building setback line: 69.95 feet <br /> Variance needed: 30.05 feet <br />
